Resolution No. 83-97 CITY OF TIGARD, OREGON RESOLUTION NO. 83— A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE COMPLETED PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN SCRECKLA PARK ESTATES SUBDIVISION, SUBJECT TO FINAL INSTALLATION OF SIDEWALKS. Wt1EREAS, the City of Tigard Subdivision. Ordinance requires subdividers to install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement. The Compliance Agreement provides that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year ... , WHEREAS, certification has now been received by the Public Works Department that all requirements of the Subidivision Compliance Agreement have beenmet and that all work is complete, except for the sidewalks; and WHEREAS, the required Maintenance Bond has remained in full force and effect throughout the normally required maintenance period of one year; and WHEREAS, the developer of said subdivision promises to complete the sidewalk net therein by August 25th, 1984 and is providing a $10,000 Performance bond to assure that such installation is done. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the completed public improvements constructed within SCHECKLA PARK ESTATES SUBDIVISION, said subdivision being recorded in Book 44 on Page 44 in Washington County, Oregon, Plat records, subject to completion of all sidewalk installation work by August 25th, 1984, except that all sidewalks on S.W. Sattler shall be completed as a condition of the passage of this resolution. AND FURTHER, the City Council herewith authorizes release of the aforesaid Maintenance Bond and accepts the $10,000 sidewalk installation Performance Bond.
