Resolution No. 83-90 CITY OF TIGARD, OREGON RESOLUTION NO. 83-90 A RESOLUTION OF THE TIGARD CITY COUNCIL CALLING FOR A SPECIAL ELECTION TO SUBMIT TO THE REGISTERED QUALIFIED VOTERS OF THE CITY A MEASURE AUTHORIZING THE CITY COUNCIL TO ISSUE CERTIFICATES OF PARTICIPATION TO FINANCE THE LEASE/PURCHASE AND REMODEL OF A TIGARD CIVIC CENTER. WHEREAS, the City Council directed the City Administrator to prepare a study of the space needs of the City; and, WHEREAS, the City Administrator presented various space need plans to the City Council and Library Board; and, WHEREAS, the study recommended two financing plans (general obligation bonds and certificates of participation) and specific site analyses; 2nd, WHEREAS, the Tigard City Charter provides that voluntary floating indebtedness in excess of $5,000 may not be incurred without the consent of the voters. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: SECTION 1: A special election is hereby called to be held in the City of Tigard on the 8th day of November, 1983, between the hours of 8:00 a.m. and 8:00 p.m. Pacific Standard Time at the polling places designated in Exhibit A for the purpose of submitting to the registered, qualified voters of the City of Tigard the proposition set forth in Section 2 belo,._ SECTION 2: The following ballot title and explanation are hereby approved with respect ^ the following measure for which purpose the following ballot title, number and form in which the question shall be printed upon tha official ballot are prescribed: CIVIC CENTER CERTIFICATES OF PARTICIPATION 52. SHALL THE CITY COUNCIL BE AUTHORIZED TO ISSUE CERTIFICATES OF PARTICIPATION UP TO $2,245,000.00 FOR CIVIC CENTER PURCHASE AND REMODEL? EXPLANATION These Certificates would fund a Civic Center. Land and existing buildings would be purchased and remodeled for Library, City Hall and Police facilities. Two financing methods are submitted in Measures No. 51 and 52. The sale of these certificates would authorize a lease and installment sale contract and constitute a debt. The Certificates are repaid from the City's annual operating budget. If both Bonds and Certificates are authorized, the Council will select the financing method. Mark a cross (x) or check ( ) inside the voting square to indicate your choice. YES ( ) NO ( ) SECTION 3: The City Recorder is hereby authorized and directed to certify in the manner provided by law to the Director of Records and Elections of Washington County, Oregon, the foregoing measures for inclusion on the ballots to be prepared by such Director for voting at all precincts within the City of Tigard, as set forth in Exhibit A herein, at the Special Election of November 8, 1983. SECTION 4: The Tigard City Recorder be, and hereby is, authorized and directed to undertake all necessary and convenient acts to facilitate the inclusion of these measures on the November 8, 1983, Special Election ballot for the approval or rejection of the qualified voters of the City of Tigard and is further authorized and directed to given notice of the above-described election and proposal in the following manner: (a) By posting notices of the election, substantially in the form set forth in Exhibit A, one at each of the designated posting places in each of the precincts in the City, not less than ten (10) days prior to the date of the election and also; f:. (b) By publishing, the notice of election substantially in the form !,. set forth in Exhibit A, in the Tigard Times once each week for two consecutive weeks, the first such publication to be not less than fifteen (15) days and the last such publication to be no less than four (4) days prior to the date of the aforesaid Special Election. SHALL THE CITY COUNCIL BE AUTHORIZED TO SELL GENERAL OBLIGATION BONDS UP TO $2,200,000.00 FOR CIVIC CENTER PURCHASE AND REMODEL? EXPLANATION This bond issue would fund Civic Center. Land and existing buildings would be purchased and remodeled for Library, City Hall and Police facilities. Two financing methods are submitted in Measures No. 51 and 52. The General Obligation Bond authorizes a tax levy to repay the debt. If both Bonds and Certificates are authorized, the Council will select the financing method.
