Resolution No. 83-75 ti• C I'1'Y OF TIGARD, OREGON RESOLU11ON NO. 83---2=E� A RESOLUTION ORDERING THE SALE OF CITY REAL PROPERTY, FIXING A MINIMUM PRICE AND SETTING THE CONDITIONS AND TERMS OF SALE. WHEREAS, the City of Tigard City Council and Budget Committee recognized in the 1983-84 budget process that certain parcels of land were no longer needed for City use, and WHEREAS, an order to sell these parcels of property must be in the records of the City, NOW THEREFORE iF IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TIGARD THAT: 1. The City Recorder is ordered to obtain from a certified or licensed appraiser, the market value of the parcels of land for sale described in Exhibit A and known as the Pinebrook lots and Old City Hall. 2. The City Recorder is ordered to proceed with the sale of parcels of land as described in Exhibit A, in accordance with ORS 275.120, 275.140-275.160 and 275.180-275.260. 3. The minimum price for the Pinebrook lots is set at a net proceeds to the City of $40,000.00. The minimum price for the City Hall site is set at a net proceeds to the City of $100,000.00. 4. The City in compliance with ORS 275.120, upon receipt of the appraisal of market value of the parcels of land for sale, will cause to have published a notice of sale establishing the time and place of sale, the description ol the property, the market value of the property, the minimum _ price as fixed by the City Council and the date of the order directing such sale. 5. The conditions and terms of sale will be as follows: a. The minimum price to be fixed at $20,000 net per lot for the Pinebrook lots and $100,000.00 net for Old City Hall. b. The sale will be in the form of sealed bids, in the amount of or more than the fixed minimum proceeds and will be accepted by the City Recorder's office on the date of sale. C. The sealed bid shall be accompanied by a deposit in good faith in an amount equal to 10% of the fixed minimum price. d• The sales shall be to the highest and best bidder for cash. e. The balance of the sale price will be paid in cash no later than 60 days from the sale date. f. The City reserves the right to reject any or all bids.
