Resolution No. 83-25 I CITY OF TIGARD, OREGON RESOLUTION NO. 83 - c0!9-- A RESOLUTION OF THE TIGARD ClJY COUNCIL AGREEING 10 RECOMMEND THAT 1HE PORTLAND METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION SET OVER THE KRUEGER ANNEXATION PENDING DEVELOPMENT OF A NEW URBAN PLANNING AREA AGREEMENT BETWEEN THE CITY OF TIGARD AND WASHINGTON COUNTY BY JUNE, 1983. WHEREAS, the CityvTigard and Washington County adopted an Urban Planning Area Agreement in 1980 which provides for a process to amend the Agreement; and WHEREAS_ Russell Krueger has requested and initiated an annexation of re property to the City of Tigard^ which is outside of the City Limits Area planning Agement but within the Urban Growth Boundary; and WHEREAS, the City of Tigard has requested amendment of the Urban Planning Area Agreement to allow for the Krueger Annexation; and WHEREAS, Washington County has indicated its preference to develop an entire new Urban Planning Area Agreement consistent with the City of Tigard - Comprehensive Plan and the Washington County Comprehensive Plan by June, 1983; and WHEREAS, The City of Tigard is desirous of developing the same new UPAA, but concerned with the possibility of further undue delays to Mr. Krueger's proposal. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TIGARD THAT: Section 1: The City of Tigard will recommend that the Portland Metropolitan Area Local Government Boundary Commission set over the Krueger Annexation to allow time for development of a more orderly and Comprehensive Urban Planning Area Agreement between the City and Washington County to be developed and adopted by June, 1983. SECTION 2: The City of Tigard's action to temporarily support a set over of the annexation is based upon its understanding that the following substantive issues will be resolved as a part of the new UPAA in June, 1983: A. Compatibility of the agreement with the model UPAA developed jointly by the County and the planning staff of cities within the County. B. Intent and implementation of the Bull Mountain, other than the Krueger Area, urbanization as an area of interest to Tigard. C. ?ntent and implementation regarding Metzger and Washington Square community urbanization as a part of Tigard's Active Plan responsibility. D. Urban Service provisions and extensions exspecially with regards to sewer service. E. Planning jurisdiction responsibilities relative to areas of interest, active plan zoning and development codestandards. F. Jurisdiction and any transfer of county roads especially relative to local versus sub-regional roads. G. Transportation planning process coordination especially relative to the Murray Road "extention/connection" and Durham Road issues. H. Process as to review and comment on City of Tigard and Washington County comprehensive plan coordination. 1. County support of City Annexation within the active plan area consistent with the UPAA. J. City Annexation into areas of intent only upon amendment of the UPAA. K. If agreement on the UPAA amendments cannot be reached, the City retains its rights under Oregon Revised Statutes and the City Charter to re-evaluate the UPAA/AP provissions and assume responsibility for a City Limits only Complementary Plan. L. UPAA Amendment process and timelines. SECTION 3: The City requests that the Washington County Board of Commissioners formally indicate its intent to resolve the foregoing issues relative to the UPAA and provide notice of said actions to the City no later than March 15, 1983. SECTION 4: If the City fails to obtain timely approval of elements for the UPAA negotiations, the City of Tigard reserves its right to pursue the Krueger Annexation on its merits before the Portland Metropolitan Area Local Government Boundary Commission on or before March 31, 1983.
