RESOLUTION NO. 83-�
A RESOLUTION OF THE TIGARD CITY COUNCIL REINSTATING THE NOTICE OF REVIEW IN
M3-81
WHEREAS, Mr. Charles Whipp filed an appeal in the Sensitive Land
Permit case on March 26, 1982; and
WHEREAS, Mr. Whipp did not pay the fee rcquirea to arrmmpanv the
appeal until April 16, 1982; and
WHEREAS, there was a misunderstanding between Mr. Whipp and the City
as to when the fee was due.
NOW, THEREFORE,
BE IT RESOLVED BY the City Council of the City of Tigard that:
Section 1: The Notice of Review of Mr. Charles Whipp in M2-82 is reinstated
and concluding that the appeal fee requirement of TMC
18.84.260(b) is not jurisdictional.
Section 2: The Council further finds that it is equitable under the
circumstances to give the right of a hearing at least.
Section 3: The hearing is set for the next available date, March 28, 1983.
The hearing vill deal with the facts surrounding the filing of
the Notice of Review and, if necessary, the merits of the case.
