Resolution No. 82-105 CITY OF TIGARD, OREGON RESOLUTION NO. 82 - IO5 L RESOLUTION OF THE TIGARD CITY COUNCIL APPROVING APRENDESENTS TO THE ADMINISTRATIVE AGREEMENT WITH ROBERT W. JEAN. WHEREAS, the Tigard City Council has determined it to be in th.e best interest of the City to amend the administrative agreement with the City administrator. NOW, THEREFORE, BE IT RESOLVED BY THE TIGARD CITY COUNCIL THAT: Section 1: The Administrative Agreement which was entered into with Robert _ W. Jean in the fall of 1981 is hereby amended as set forth in the attached Exhibit "A". JEAN THIS EMPLOYMENT AGREEMENT AMENDMENT, made and entered into this 13th day Of September, 1982, by and between the CITY OF TIGARD, OREGON, hereinafter referred to as "CITY", and ROBERT W. JEAN, hereinafter referred to as "EMPLOYEE". WHEREAS, the CITY OF TIGARD, OREGON, and the EMPLOYEE, ROBERT W. JEAN, have an EMPLOYMENT AGPEEMENT for his services as City Administrator dated August 24, 1981; and, WHEREAS, both the CITY and the EMPLOYEE mutually seek to amend the AGREEMENT; THEREFORE, the CITY and EMPLOYEE agree that the following changes shall be made to the original AGREEMENT: SECTION 1 -- DUTIES. No change. SECTION 2 -- TERM. No change, but ratify existing ter- of agreement through 2/28/83 and this extension for an additional year through 2/28/84. SECTION 3 -- RENEWALS. No chanq-a. SECTION 4 -- TERMINATION AND SEVERANCE. No change, except sub-section C. is amended as follows: "In the event EMPLOYEE in invol.untaril.y terminated by the City Council before expiration of the term of employment and during such time as the EMPLOYEE is willing and able to perform the assigned duties, then in that event the CITY agrees to pay EMPLOYEE a lump sum equal to two (2) month's pay and two monthly payments each month after termination, the total of which shall be a severance payment equal to three-{3} four (4) months pay at the EMPLOYEE'S highest rate of pay during his term of City employment.: Sub-section E. is amended to read: "If EMPLOYEE voluntarily resigns his position with the CITY before expiration of said term of employment, then EMPLOYEE shall give the CITY at least 014E-{}}-aeRtH1s forty-five days notice in advance." A new Sub-section F. is added as follows: "Expiration of the AGREEMENT term due to non-renewal by CITY shall entitle EMPLOYEE to severance as provided for involuntary termination during mid-term of the AGREEMENT in Section C., but reduced as follows: 120-91 days notice for two (2) months severance; 31-90 days notice for three (3) months severance; 30 days or less for four (4) months severance." SECTION S -- SALARY. No change. Next cost Of living adjustment on 7/1/83 and ratify next merit pay review date as 9/1/83. SECTION 6 -- RETIREMENT. No change. SECTION 7 -- PROFESSIONAL DEVELOPMENT. No change. SECTION 8 -- ANNUAL GOAL-SETTING AND PERFORMANCE EVALUATION. No change, except as follows: "These annual evaluations shall be in closed Executive Session and shall be conducted at least e26xtp-{6B} one hundred and twenty the annual renewal date of this agreement." (120) days prior to SECTION 9 -- GENERAL.
