Resolution No. 82-40 CITY OF TIGARD, OREGON RESOLUTION NO. 82- G a RESOLUTION OF THE TIGARD CITY COUNCIL SEGREGATING THE ASSESSMENT ON GALTON AND MEEKCOMS PROPERTY IN THE VARNS ROAD LID NO. 16. WHEREAS, the State of Oregon is acquiring a portion of this parcel for right-of-way for construction of the Hwy. 217/72nd Avenue off-ramp; and WHEREAS, the State of Oregon wishes to acquire the property free of liens; and WHEREAS, the city and and the property owners have reached an agreement for the satisfaction or segregation of this assessment, NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes the Mayor of the City of Tigard to sign an agreement with the property owners, ZANLEY and CLAIRE GALTON and DANIEL and RACHELLA MEEKCOMS, containing the following provisions: "r t; 1) That a Bancroft bonding agreement has been signed for the total amount assessed to the remaining parcel; Aft, 2) That the property owners agree that within thirty (30) days of signing the agreement, the property owners will satisfy the lien relating to the street improvement which is attributable to the M portion of the parcel the state is taking. The amount due will be s $5,911.88 principal. All interest costs owing are payable now; 3) The property owners agree that the amount of the sewer assessment, $6,255.78, owed for the portion being acquired by the ' state is transferred to the remaining portion of the parcel being retained by the property owners; 4 4) The property owners agree that they are obliged for both `< amounts of the street and sewer assessments attributable to the remaining portion of the parcel which they are retaining. These amounts are $16,031.82 for sewers and $12,986.88 for streets; and -� 5) The property owners further agree that once the lien for cA $5,911.88 referred to in paragraph 2 above has been satisfied, the property owners will remain obligated for a total of $35,274.48, representing $22,287.60 for sewers and $12,986.88 for streets.
