RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE FINAL PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN MUTTLEY'S SUBDIVISION.
WHEREAS, the City of Tigard Subdivision Ordirance requires installation
of streets, sidewalks, streetlights, s'orm sewers, curbs, sanitary sewers, under—
ground utilities and other public facilities for the development of subdivision;
and
WHEREAS, the City further required the payment of fees and execution of
a Compliance Agreement, which stipulated that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance
Bond, the City Council agrees to accept the public improvements
subject to the requirement for correction of deficiencies and
maintenance for a period of one year..."and
WHEREAS, the City Council received conditional certification from the
Department of Public Works and the maintenance guarantee. and
WHEREAS, the City Council accepted said improvements, subject to correction
of specified deficiencies during the maintenance
period, via Council Resolution
31 No. 77-3 and
ji WHEREAS, the Department of Public Works has now certified that specified
deficiencies have been corrected, and all public improvements thereinregard said
subdivision are complete, and
WHEREAS, the required one year maintenance period has passed
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon,
hereby accepts all public improvements constructed within Muttley's Subdivision
recorded in Book 37 on Page 39 in Washington County, Oregon, Plat Records,
AND FURTHER, hereby authorizes release of the maintenance guarantee bond.
