Resolution No. 81-78 5d 1 CITY OF TIGARD, OREGON �r RESOLUTION NO. 81-_2g A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC SANITARY SEWER IMPROVE- MENTS KNOWN AS THE KIMBERLY (MCCOY) SANITARY SEWER EXTENSION, GENERALLY LOCATED WEST OF S.W. 98TH AVENUE ON SW KIMBERLY DRIVE. WHEREAS, the City executed a Sanitary Sewer Compliance Agreement, dated April 14, 1980, with Kazebee-Marshall Construction Company, to install a public sanitary sewer line and appurtenances thereto, to specified standards; and WHEREAS, the Compliance Agreement stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met a,vI a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year..."; and WHEREAS, the original performance bond, in lieu of a seperate maintenance bond, has remained in full force and effect throughout the normally required maintenance period of one year, and WHEREAS, the Public Works Department has now certified that the specific terms and conditions of said agreement and bond have been satisfactorily completed; and WHEREAS, no deficiencies remain to be corrected thereinregard, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public main line sanitary sewer improvements known as the Kimberly (McCoy) Sanitary Sewer Exteasion; AND FURTHER, the City Council herein authorizes release of the aforsaid guarantee bond.
