A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC STREET IIPROVEMENTS
KNOWi: AS SW 109TH AVENUE, GENERALLY LOCATED SOUTH OF SW MURDOCK STREET AND
ADJACENT.' TO CANTERBURY WOODS.
WHEREAS, the City executed a Street Dedication Compliance Agreement,
dated September 11, 1978, with Hoffman 5 Hoffman Hilltop Estates, to facilitate
installation of a public dedicated street and appurtenances thereto, to specified
standards; and
WHEREAS, the City Council had tentatively accepted the aforsaid improve-
ments subject to the normal one year guarantee period; and j

WHEREAS, a guarantee bond has been on file, as required by said agreement,
ensuring continued maintenance and correction of deficiencies throughout the one
year guarantee period; and
WHEREAS, the Public Works Department has issued certification that all 3
maintenance and deficiencies thereinregard have been satisfactorily corrected; I
and
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby
accepts the public street improvements known as S.W. 109th Avenue, said street
right-of-way being recorded by document number 80011754 in Washington County,
i" Oregon, fee Records;
AND FURTHER, the City Council herein authorizes release of the guarantee
r. bond.
