Resolution No. 81-45 CITY OF TIGARD, OREGON RESOLUTION NO. 81-_q5- RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN SU124ERFIELD DRIVE, WEST OF S.W. 98TH AVENUE. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, under- ground utilities and other public facilities for the development of subdivision; and WHEREAS, the City required the payment of fees and the execution of a Street Dedication Compliance Agreement dated November 26, 1973 which sitpulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance (for a period of five years..)"; and WHEREAS, said Certification has now been received; and WHEREAS, the original performance bond has remained in full force and effect beyond the required maintenance period, and WHEREAS, the deficiencies which were required to be corrected therein have been repaired, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within the right-of-way of S.W. Summerfield Drive, west of S.W. 98th Avenue, as recorded in Book 954 on Page 340-344 in Washington County, Oregon, Deed Records.
