Resolution No. 80-97 S c.. CITY OF TIGARD - RESOLUTION NO. 80--2 A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC STREET IMPROVEMENTS KNOWN AS S.W. KATHERINE STREET EXTENSION, GENERALLY LOCATED WEST OF S.W. 121ST AVENUE, SUBJECT TO HEREIN SPECIFIED CONDITIONS. WHEREAS, the City executed a Street Dedication Compliance Agreement, dated December 18, 1978, with School District 23J, to facilitate installation of a public dedicated street, and appurtances thereto, to specified standards; and WHEREAS, the Compliance Agreement sitpulated that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public ;mprovements, subject to the requirements for correction of deficiencies and maintenance for a period of one year .. ; and" WHEREAS, said Certification has now been received, subject to correction of hereinbelow listed deficiencies and any deficiencies which may become apparent or which may arise; and WHEREAS, the principal has indicated a desire to retain their existing performance bond in full force and effect throughout the aforsaid guarantee period, in lieu of submitting a separate maintenance bond only, and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public street improvements known as S.W. Katherine Street, said right- of-way being recorded in Book 836 on Page(s) 239-241 in Washington County, Oregon, Deed Records, subject to: 1. The sidewalks need to be completed along SW Katherine Street. 2. Wheelchair ramps need to be installed at each intersection. 3. The one inch A.C., Class "C", overlay needs to be installed. 4. A written certification from the project engineer needs to be submitted to the City, to the effect that all workmanship and materials thereinregard said installation are in accord with best practices and are of high grade. 5. Correction of any deficiencies and maintenance which may arise during the maintenance period needs to be continued. 6. Continuation of the existing performance bond. AND FURTHER, subject to the conditions of obligation of the aforsaid maintenance period.
