CITY OF TIGARD, OREGON
RESOLUTION No. 80-1
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE FINAL PUBLIC IMPROVEMENTS CON-
STRUCTED WITHIN BARTON SUBDIVISION.
WHEREAS, the City of Tigard Subdivision Ordinance requires installation of
streets, sidewalks, str,-etlights, storm sewers, curbs, sanitary sewers, underground
utilities and other public facilities for the development of subdivisions; and
WHEREAS, the City further required the payment of fees and execution of a
Compliance Agreement, which stipulated that:
"Upon receipt of certification by the Department of Public Works that
all requirements have been met and a One Year Maintenance Bond, the
City Council agrees to accept the public improvements subject to the
requirement for correction of deficiencies and maintenance for a
period of one year...;" and
WHEREAS, the City Council received conditional certification from the
Department of Public Works and the maintenance bond, and
WHEREAS, the City Council accepted said improvements, subject to correction
of specified deficiencies during the maintenance period, via Resolution No. 78-82,
and
WHEREAS, the Department of Public ':forks has now certified that said specified
deficiencies have been corrected, and all public improvements thereinreQard said
subdivision are complete, and -
3 WHEREAS, the required one year maintenance
period has passed
9' NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby
accepts all public improvements constructed within Barton Subdivision, said
subdivision, being recorded in Book 40 on Page 25 in Washington County, Oregon,
Plat Records,
AND FURTHER, hereby authorizes release of the maintenance bond.
