RESOLUTION OF THE TIGARD CITY COUNCIL ',CCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED
WITHIN AbfART SUMMERLAKE (PHASE I) SUBDIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS. t
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to !
install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers,
underground utilities and other public facilities for the development of subdivision;
and

WHEREAS, the City has required the payment of fees and the execution of a '
Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works that !
all requirements have been met and a One Year Maintenance Bond, the
City Council agrees to accept the public improvements, subject to the
requirements for correction of deficiencies and maintenance for a
period of one year...; and
WHEREAS, said Certification has now been received, subject to correction
?' of hereinbelow listed deficiencies; and j

"r WHEREAS, the subdivider has indicated a desire to retain the subdivision
Eperformance bond in full force and affect throughout the aforsaid maintenance
period, in lieu of submitting a separate maintenance bond, �.
NOW, THEREFORE,

BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby
accepts the public improvements constructed within Amart Summerlake (Phase I) Sub-
division, said subdivision being recorded in Book 47 on Page 37 in Washington County,
Oregon, Plat Records, subject to: $:
a 1. Correction of deficiencies/defects per letter from City to
Lutz Development Company dated July 23, 1980 (copy attached
hereto).
2. Correction of deficiencies/defects which may arise during
the maintenance guarantee period.
3. Continuation of the subdivision performance bond or submission
P of a satisfactory (separate) maintenance bond, in the sum of
$160,342.20, in Lieu thereof.
