Resolution No. 79-116 CITY OF TIGARD, OREGON RESOLUTION NO. ")°1-11 G RESOLUTION OF THE TIGARD CITY COUNCIL TENTATIVELY ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN AMES ORCHARD SUBDIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City normally requires the payment of fees and the execution of a Compliance Agreement, for subdivisions developed within the City, which stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of aeficiencies and maintenance for a period of one year ...; and WHEREAS, Ames Orchard Subdivision was developed within Wash. County and, prior to completion, has been annexed to the City; and subsequently, the facilities therein are proposed to become a city maintenance responsibility; and WHEREAS, in light of all of the aformentioned an acceptable Maintenance Bond has now been received and is proposed to be subject to the aforsaid normally required maintenance period, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby accepts the public improvements (except the L.I.D. Storm Drainage facility) constructed within Ames Orchard Subdivision, said subdivision being recorded in Book 39 on Page 37 in Washington County, Oregon, Plat Records, subject to: 1. Correction of deficiencies in accord with the attached letter (dated October 19, 1979) titled Exhibit "A"; and 2. Correction of any deficiencies, including general maintenance, which may arise during the one year maintenance guarantee period. AND FURTHER, subject to the conditions of obligation of the aforsaid Maintenance Bond. I will take the most easily resolved area first, that of the final Configuration of the streets and other surface improvements in Ames Orchard Subdivision. I wish to make a suggestion which I think will satisfy many of our concerns avid be of less expense to you. First, and as substitute for the extensive rocking we discussed previously, would be to use a permanent pavement marking to delineate the bikeway and the pedestrian walkways on all streets, as described below: i Permanent Pavement Markimts (Thermo plastic material with reflective beads to be placed, hot in liquid form) . SW Hazeltree Terrace and SW Hazelhill Drive 4" wide delineation, to identify bikelane, 6 feet from east edge of pavement. 4" wide delineation to identify pedestrian walkway, 4 feet from west edge of pavement (no centerline) . Corylus Court 4" wide delineation, to identify pedestrian walkway on both sides and all around the cul-de-sac bubble, 4 feet from pavement edge. With additional 8" traffic buttons at all intersections (to be marked in the field) 8" buttons shall be ceramic of the same color throughout and attached to the pavement with an appropriate epoxy cement. In additions some specific items listed below need to be accomplished: Maintenance bond must be altered to run in favor of the City of Tigard. All areas where ditch erosion protection Inas been damaged will need to be repaired or replaced. These areas are marked in the field on the pave- ment adjacent to the needed repair with the letter "P" between two limit lines. Some slopes between the edge of the pavement and the ditch bottom need additional rock. These areas are marked in the field on the edge of the 's pavement with the letter "R" between two limit lines. The intent would be to establish a slope at the center, between limit lines, approaching 2:1 and taper to match the slope at the limit lines. ' Areas where the pavement has been dammed crist be repaired - these areas are circled in the field. Rock dams need to be established at each catch basin which 'straddles• the x ditch. hock Should be 4" - 12" size. Specific catch basins will have a "RD" painted on the edge of the pavement adjacent to the catch basin. The storm drain outles at the SW corner of SW Hazeltree Terrace and SW Hazelhi.11 Drive will require 4" - 12" rip rap placed in such a manner that the top of the rip rap conforms to the existing ditch bottom. An additional length of storm drain pipe must be placed in such a way as to drain the low spot in the ditch adjacent to Lot 022. All streets must be cleaned. The City will take the responsibility to contact home owners who have made improvements in the right-of-way without appropriate permits. I would anticipate that I.Codld:ppnrove the roadway and surface improvements with- in the public rights-of-way subject to the above conditions being completed. • Page 3 Gary Ames October 19, 1979 •:Gary, the second of my two concerns, the storm drain system, is not so easily re— solved because it involves, what I consider to be, an inadequate and ina,propriate method of disposal of excess storm water. To be able to evaluate the storm drain system, I first need an as built of the improvements in Amas Orchard. Second„I need a copy of the L.I.D. ageement for maintenance and operation of that system. Thirdly, I need the criteria and the v; computations used to determine the design of the retention systems. Without this specific information, relating to the storm drain system, I cannot make any recd—endations to the City Council concerning acceptance.
