Resolution No. 79-97 CITY OF TIGARD RESOLUTION NO. 79-_f/:�7 RESOLUTION OF THE TIGARD CITY COUNCIL TENTATIVELY ACCEPTING THE PUBLIC STREET IMPROVE- MENTS KNOWN AS SW 68TH PARKWAY, BETWEEN SW HAMPTON STREET AND (NOW VACATED) SW IRVING c STREET. WHEREAS, Lamb-Weston, an Amfac Company, proposed to improve SW 68th Parkway, between SW Hampton Street and (now vacated) SW Irving Street, to City standards and specifications; and WHEREAS, the City required the payment of fees and the execution of a Street Opening Permit and the posting of approvable construction plans thereinregard; and WHEREAS, said permit stipulated that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year .. ; and WHEREAS, said Certification has now been received; and WHEREAS, Lamb-Weston has indicated a desire to retain the existing performance bond in full force and effect throughout the aforsaid maintenance period, in lieu of submitting a separate maintenance bond, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Cregon hereby accepts the public improvements known as SW 68th Parkway, between SW Hampton Street and (now vacated) SW Irving Street, subject to: 1) Continuation of the existing performance bond, for a period of one year. 2) Correction of deficiencies and continued maintenance, for a period of one year.
