RESOLUTION NO. 79- q(1
A RESOLUTION CONCERNING VACATION OF A TRACT OF LMND IN BROOKWAY AND LAKE
TERRACE SUBDIVISIONS.
lgHEREAS ,the area described in Exhibi'_s A, B, and C (which are
hereby incorporated in this resolution) lie within the corporate boundaries
of the City of Tigard, Oregon; and
WHEREAS the described area does not serve a public purpose and is
so situated as to be of no use now or in the future as part of a public
street system, park system, greenway system, or other public system of the
City; and
WHEREAS it appears to ?,e in -the public interest that the
described area be vacated and made available for the private maintenance
and use of the adjacent landowners; and
WHEREAS pursuant to ORS 271.130 the City Council of the City of
Tigard is authorized to initiate vacation proceedings under these circum-
stances,
r NOtl, THEREFORE_, BE IT RESOLVED by the City Council of the City of
Tigard:
1_ That a public hearing' is hereby called to be held
by the City Council of Tigard on Monday, Nove.lber 26,
1979 at Fowler Junior High School Lecture Room,
10865 SW Walnut Street, Tigard, Oregon, beginning at
8 p.m., at which time and place the Council shall
hear any objections to the proposed vacation, and
any interested person may appear and be heard for or
against the proposed vacation of the described land.
2. The City Recorder is hereby authorized and directed
to cause to have published in the Tigard Times, a
newspaper of general circulation in the City of
Tigard hereby designated for such purpose, a notice
of the hearing of *?ovember 26 in the form hereto
attached and by this reference made a part hereof,
the first publication to be made on the12,_ day of
October 1979 and once each week thereafter .for five
publishings in all.
-he City Recorder is hereby further directed to
cause to have posted within five days after the
date of first publication a copy of the notice in
the form attached to this resolution, at or near
each end of the area proposed to be Vacated, and,

in addition, the City Recorder shall post a copy
of the notice in at least two conspicuous places
within the area proposed to be vacated, all of
those postings to be accomplished within the
time :escribed in this resolution.
3. The particular portion of dedicated land proposed
to be vacated is described on the attached sheet
headed Exhibits A, B, and C, and by this reference
made a part hereof.

That portion of land in the Northwest quarter of Section 3, To,,mship 2 South,
Range 1 West, Willamette Meridian, Washington County, Ore^,on, being more
particularly described as follows:
Beginning at the most Southerly corner of 'TRACT "C" of BROOKS-MY, a subdivision
of record in said County; running thence North 500 38' 24" East a distance
of 62.23 feet to a 5/8" iror rod; thence South 010 34' 40" West a distance
of 166.71 feet to a 5/8" iron rod; thence on a 192.20 foot radius curve
to the left, the long chord of which bears North 180 53' 28" West 134.42 feet,
an arc distance of.137.33 feet to the point of beginning of this description.
Containing 2823.6 square feet, more or less.
