RESOLUTION NO..79-9'/
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED
WITH GENESIS I SUBDIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS.
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers
to install streets, sidewalks, street lights, curbs, storm sewers, sanitary
sewers, underground utilities and other public facilities for the development of
subdivision; and
WHEREAS, the City has required the payment of fees and the execution of
a Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance
Bond, the City Council agrees to accept the public improvements,
subject'to the requirements for correction of deficiencies and
maintenance for a period of one year...; and
WHEREAS, said Certification has now been received, subject to
correction of hereinbelow listed deficiencies; and
WHEREAS, the subdivider has indicated a desire to retain the subdivision
performance bond in full force and effect throughout the aforsaid maintenance
period, in lieu of submitting a separate maintenance bond,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby
accepts the public improvements constructed within Genesis I Subdivision, said
subdivision being recorded in Book 42 on Page 31 in Washington County, Oregon,
Plat Records, subject to:
1. Sidewalk completed along SW Genesis Loop.
2. Sidewalk repairs along SW 115th Avenue east side of the street.
3. Sidewalk repaired at Lot #16.
4. Curbs and aprons repaired in parking islands in SW Nova Court and
SW Venus Court.
5. Curb repaired at the north end of cul-de-sac on SW Venus Court.
6. Exist;ng driveway cut be removed on SW 115th at Lot 1.
7. Installation of the one (1) inch Class "C" AC overlay on all streets f
in Genesis I. {-
