Resolution No. 79-41 CITY OF TIGARD, OREGON RESOLUTION No. 79-.,LLA RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN PAYLESS SHOPPING CENTER SUBDIVISION. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year ..."; and WHEREAS, said Certification has now been received; and WHEREAS, the required performance bond has remained in full force and effect throughout the normally required maintenance period of one year, and WHEREAS, no deficiencies remain to be corrected therein, I NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby accepts the public improvements constructed within Payless Shopping Center Subdivision, said subdivision being recorded in Book 37 on Page 46 in Washington County, Oregon, Plat Records. AND FURTHER, the City Council herewith authorizes release of the aforesaid bond. PASSED: This _day of M Q N _, 1979, by the Council of the City of Tigard, Oregon. Mayor Recorder
