RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING SANITARY SEWER I14PROVEMENTS
CONSTRUCTED FOR PUBLIC USAGE, SAID IMPROVEMENTS BEING KNOWN AS THE 115th
AVENUE EXTENSION (STA. 0+00 to 2+91.5). t
WHEREAS, the City of Tigard approved a request for extension from, and
construction of, a public sanitary sewer from Mr. Don Morissette, known as
the 115th Avenue Sanitary Sewer Extension (Sta. 0+00 to 2+91.5); and
WHEREAS, the City required the payment of fees, the posting of a
Performance Bond and the execution of a Compliance Agreement dated
July 8, 1977, which stipulates that:
" . Upon receipt of certification by the Department of Public Works
that all requirements have been met, and a One Year Maintenance Bond,
the City Council agrees to accept the public improvements subject to
the requirement of correction of deficiencies and maintenance for a
period of one year ..."; and
WHEREAS, said Certification has been received; and
WHEREAS, the aforsaid performance bond remained in full force and effect
for the normally required one year maintenance period, in lieu of submittal
of a seperate bond therefor, and all deficiencies are corrected;

NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, �.
hereby accepts the public sewer improvements herein named for public I ,
operation and maintenance;
AND FURTHER, the City Council herewith authorizes release of the pre-
viously posted performance bond hereinregard.
