Resolution No. 79-08 C CITY OF TIGARD, OREGON RESOLUTION NO.7?-V RESOLUTION OF THE TIGARD CITY COUNCIL UPDATING RESOLUTION 75-60 TO RE-ESTABLISH NEIGHBORHOOD PLANNING ORGANIZATIONS, PRESCRIBING AUTHORITIES, RESPONSIBILITIES AND MEMBERSHIP STRUCTURE. WHEREAS, the Council is cognizant of the need to document and recognize the channels of communication which have been developed between the people of Tigard and the City officials on matters affecting neighborhood livability and economic viability; and WHEREAS, the State of Oregon Land Conservation and Development Commission (LCDC) has mandated that cities develop a Citizen Involvement Program ensuring the opportunity for citizens to become involved in all phases of the land-use planning process; and WHEREAS, the City has instituted a Citizen Involvement Program and the experience gained from operating this program for the past five years has made it possible to establish an official structure for the Citizen Involvement Program, NOW;, THEREFORE, BE IT RESOLVED by the City Council of the City of Tigard that: Section 1: TITLE Neighborhood Planning Organizations (NPO's) are hereby officially recognized and reorganized to act as the official citizen involvement structure as re- quired under L.C.D.C, goals and guidelines to ensure citizen involvement in the Tigard Planning Program and all such past involvement is officially rec- ognized as in integral part of the Citizen Involvement Program. GOAL #1 of LCDC statewide Planning Goals and Guidelines is briefly stated below: To develop a Citizen Involvement Program that ensures the opportunity for citizens to be involved in all phases of the planning process. The governing body charged with preparing and adopting a comprehensive plan shall adopt and publicize a program for citizen involvement that clearly defines the procedures by which the general public will be involved in the on-going land-use planning process. The Citizen Involvement Program shall be appropriate to the scale of the planning effort. The program shall provide for continuity of citizen par- ticipation and of information that enables citizens to identify and com- prehend the issues. Federal, state and regional agencies and special purpose districts shall coordinate their planning efforts with the affected governing bodies and make use of existing local Citizen Involvement Programs established by counties and cities. F Section 2: DEFINITIONS (a) "Neighborhood Planning Organization" (NPO) shall mean a group of people organized within the boundaries of one neighborhood area for the purpose of considering and acting upon a broad range of issues affecting neighborhood livability. (b) "Neighborhood Area" shall mean one of seven distinct planning areas within the city boundaries as recognized by the adoption of an NPO Plan. (c) "City Agency" shall mean departments, offices, boards and commissions of the City. (d) The response by the Citizens Involvement Committee in accomplishing tasks outlined in Goal #1 shall be known as the Citizen Involvement Program of Tigard. Section 3: NEIGHBORHOOD PLANNING ORGANIZATIONS (a) Membership - The membership of NPO's shall be open to residents, property owners, business licensees and representatives of non-profit organizations, 18 years and older located within the neighborhood boundaries. The membership of each NPO shall be twelve (12) members from each of the seven distinct NPO areas within the city boundaries. All persons wishing to serve on an NPO will complete the petition forms with fifteen (15) sig- natures of persons within a specific NPO area and submit them to the Planning Director who will file them with the City Recorder and submit names to the Planning Commission for selection of NPC members. 1. The membership of each NPO shall be as nearly representative as pos- sible of the major interest groups existing in the neighborhood. The Planning Commission shall hold a public hearing which shall recommend membership for each NPO. The City Council shall then act on the recommendations of the Planning Commission. 2. Special attention should be paid to the conflict of interest potential in nominating persons to serve on each NPO. The main thrust of this program must be towards citizen representation. 3. In order that the NPO's may maintain a membership having a continuum of experience in dealing with land use planning issues in the neigh- borhood, it is intended that NPO Members retain their positions for four (4) years. Resigning members will be replaced by persons eligible for NPO.Membership who obtain a petition bearing the names of fifteen (15) persons from their designated NPO area. These petitions will be dated and certified by the City Recorder and placed on file. When a vacancy occurs replacement will be made by taking the petition bearing the earliest date of certification. Persons having petitions on file with the City will be contactea in January of each year to ascertain if they will continue their NPO membership availability. If not, their petition shall be removed from-the file. RESOLUTION No.27 Page 2 ��et A person replacing a resigning NPO member will complete the four year term of the person being replaced. At the completion of each first four year term, NPO members may renew their membership by obtaining the names of 15 eligible persons on a petition and submitting said petition to the Planning Director who shall forward same to the City Recorder for filing. As a condition of continued membership on the NPO°s, each member shall not be absent for more than two (2) consecutive regularly convened meetings unless an approval for such absence shall have been granted by the chairperson of the affected NPO. Three (3) consecutive absences shall automatically constitute forfeiture of membership. An attendance record shall be maintained by the Chairman of each NPO. (b) Boundaries - The boundaries of the neighborhoods have been previously defined by the Planning Commission and approved by the City Council. A map of these boundaries is available at City Hall. (c) Funding - The paying of dues or membership fees shall not be required for membership or voting. The City will provide mailing services and the assistance of Planning Department Staff as needed. (d) Functions - A recognized NPO shall have the following duties, re- sponsibilities and opportunities: 1. To be involved in inventorying, recording, mapping, describing, analyzing, and evaluating the elements necessary for the upgrading and modifications of the NPO. 2. To participate in developing a body of sound information to identify public goals, develop policy guidelines and evaluate alternative land conservation and development plans for the preparation of the comprehensive land-use plan. 3. To have the opportunity to review and recommend changes to the proposed comprehensive land-use plans prior to the public hearing process to adopt or modify these plans. 4. To have the opportunity to recommend an action, a policy or a comprehensive plan to the City and to any city agency on any matter affecting the livability of the neighborhood, including, but not limited to, land use, zoning, housing, community facilities, human resources, social and recreational programs, traffic and transportation, environmental quality, open space and parks. 5. To have the opportunity to participate in the development, adoption and application of legislation that is needed to implement a comprehensive land-use plan. 6. To have the opportunity to review each proposal and application for a land-use action prior to the formal consideration of such proposal and application. RESOLUTION No. Page 3 7. To have the opportunity to be involved in the evaluation of the comprehensive land-use plans. B. To have the opportunity to review and make recommendations on proposed changes in comprehensive land-use plans prior to the public hearing process. 9. To have the opportunity to assist City agencies in determining priority needs for the neighborhood.. 10. To have the opportunity to review items for inclusion in the City budget and make recommendations relating to budget items for neighborhood improvement. 11. To undertake to manage projects as may be agreed upon or con- tracted with public agencies. 12. They shall be responsible for seeking the views of the people affected by proposed policies or actions before adopting any recommendations. 13. Dissenting views on any issue considered by a Neighborhood Planning Organization shall be recorded and transmitted, along with any recommendations made at the request of the dissenting minority, to the City. Section 4: MUTUAL RESPONSIBILITY (a) Notice and Public Information 1. All NPO's and City agencies shall undertake to notify affected persons of planning efforts which might effect them. 2. Notice of pending policy decisions affecting neighborhood livability and economic viability shall be given through distribution of Planning Commission and City Council agendas to NPO Chairpersons. 3. NPO's and City agencies shall abide by the laws regulating open meetings and open access to all information not protected by the right of personal privacy. (b) Planning 1. The NPO's and City agencies shall include.each other in all planning efforts which affect neighborhood livability and economic viability. 2. Comprehensive plans and amendments thereto recommended to the City by NPO's shall be the subject of a public hearing within a reason- able time. All comprehensive plan action of the City Council shall be based upon findings of fact and such findings shall be transmitted to each NPO affected thereby. S Section 5. Well, we are charged with responsibilities by state agencies and local. officials to accomplish certain tasks related to planning in this community. There have been significant changes in relation to each NPO area and we need `w•,4' to have you lielp us redefine your intent. We would like to get to know you, and to hear your opinions on matters which directly effect the livability of your community. Membership will be on a voluntary basis.
