RESOLUTION No. 78--
RESOLUTION
8--RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING SANITARY SEWER IMPROVEMENTS
CONSTRUCTED FOR PUBLIC USAGE, SAID IMPROVEMENTS BEING KNOWN AS THE BARNUM PARK
SANITARY SEWER EXTENSION.
WHEREAS, the City of Tigard approved a request for extension from and F.
construction of, a public sanitary sewer, known as the Barnum Park Sanitary Sewer
Extension; and,
WHEREAS, the City required the payment of fees, the posting of performance
and Maintenance Bonds and the execution of a Compliance Agreement, which stipulated
that:
" ..Upon receipt of certification by the Department of Public Works that
all requirements have been met, and a One Year Maintenance Bond, the City
Council agrees to accept the public improvements subject to the requirement
of correction of deficiencies and maintenance for a period of one year....";
and,
WHEREAS, said Public Works Department Certification has now been received;
and,
WHEREAS, said Maintenance period has now expired and all maintenance was
satisfactorily performed thereinregard,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby
accepts the public sewer improvements herein named,
AND FURTHER, the City Council herewith authorizes release of the previously
posted bonds thereinregard.
