Resolution No. 78-21 CITY OF TIGARD, OREGON RESOLUTION No. 78-_.2L RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE FINAL PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN MAYFAIR SUBDIVISION. WHEREAS, the City of Tigard Subdivion Ordinance requires installation of streets, sidewalks, streetlights, storm sewers, curbs, sanitary sewers, underground utilities and other public facilities for the development of sub- divisions; and WHEREAS, the City required the payment of fees and execution of a Compliance Agreement, which stipulated that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One-Year Maintenance Bond, the City Council agrees to accept the public improvements subject to the requirement for correction of deficiencies and maintenance fo, a period of one year . . . and, WHEREAS, The City Council received conditional certification from the Department of Public Works and the maintenance bond, and WHEREAS, the City Council accepted said improvements, subject to correction of specified deficiencies during the maintenance period, via Council Resolution No. 77-40, and WHEREAS, the Department of Public Works has now certified that said specified deficiencies have been corrected, with the exception of an overlay which said department recommends be deleted as a requirement, and all public improvements thereinregard said subdivision are complete, and WHEREAS, the required one year maintenance period has passed NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts all public improvements constructed within MAYFAIR subdivision, said subaivision being recorded in Book 37 on Page 21 in Washington County, Oregon, Plat Records, AND FURTHER, hereby authorizes release of the maintenance bond and deletes the requirement of an overlay.
