Resolution No. 77-40 CITY OF TIGARD, OREGON? RESOLUTION No. 77 4 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVE- DTNTS CONSTRUCTED WITHIN MAYFAIR SUBDIVISION. WHEREAS, the City of Tigard Subdivision Ordinance requires the installation of streets, sidewalks, streetlights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City required the payment of fees and execution of a Compliance Agreement, which stipulated that: "At such time as all public improvements except sidewalks and street trees within said subdivision have been completed in accordance with the City's requirements, petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the petitioner will submit to the City a good and sufficient maintenance bond, if not already provided with the performance bond, form approved by the City in the sum of 85,347.50 to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year after final acceptance of the ^ublic improvements of said. subdivision by the City;" and further that "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maint- enance Bond, the City Council agrees to accept the public improve- ments, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth;" and and WHEREAS, the petitioner has now requested final inspection; WHEREAS, said certification has now been received, subject to the hereinafter listed conditions; and WHEREAS, said maintenance bond has been received. NOW, THEREFORE, BE IT PESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Mayfair subdivision, said subdivision being recorded in Book 37 on Page 21 in Washington County, Oregon, Plat Records, subject to com- pletion of the following: 1) Installation and energization of three (3) streetlights, as per the approved plan. 2) Placement of a one (1) inch asphaltic concrete Class "C" overlay on all roads within the development within one year, as per the approved plan. 3) Provide for surface water drainage, at north end of curb on S.W. 95th. Avenue, directing runoff to pipe or ditch. AND FURTHER, having received the aforesaid maintenance bond, authorizing release of the original performance bond. PASSED: This 14 day of ,yam, 1977.
