RESOLUTION No. 77- 1
RESOLUTION OF TfLF TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS y
CONSTRUCTED WITHIN MUTTLEY'S ADDITION SUBDIVISION.

WHEREAS, the City of Tigard Subdivision Ordinance requires
the installation of streets, sidewalks, streetlights, storm sewers,
sanitary sewers, underground utilities and other public facilities
for the development of subdivisions; and
WHEREAS, the City required -the payment of fees and execution }
of a Compliance Agreement, which stipulated that:
"At such time as all public improvements except sidewalks and
street trees within said subdivision have been completed
in accordance with the City's requirements, petitioner shall
notify the City of the readiness for final inspection and ,
upon certification by the Department oP Public Works that all
requirements of the City have been met, the petitioner will
submit to the City a good and sufficient maintenance bond,
if not already provided with the performance bond, form
approved by the City in the sum ofX55,357.22 to provide
for correction of any defective work or maintenance becoming
apparent or arising within one (1) year after final ,
acceptance of the public improvements of said subdivision
by the City;" and further that
"Upon receipt of certification by the Department of Public
Works that all requirements have been met and a One Year Maint-
enance Bond, the City Council agrees to accept the public improve-
ments, subject to the requirements for correction of deficiencies
and maintenance for a period of one year as hereinabove set
forth;" and
WHEREAS, the petitioner has now requested final inspection;
and
WHEREAS, said certification has now been received, subject
to the hereinafter listed conditions, and
r WHEREAS, said maintenance bond has been received `
NOW, THEREFORE, '
BE IT RESOLVED that the City Council of the City of
Tigard, Oregon, hereby accepts the public improvements constructed
within Miittley's Addition subdivision, said subdi-*ision being ,
recorded in Book 37 on Page 39 in Washington County, Oregon,
Plat Records, subject to completion of the following: °

I.) Installation of all sidewalks by September 1, 79, as
r Compliance Agreement, r 9 ( . [
2.) Installation o£ all landscaping bySeptember 1, 79, (
as per Compliance Agreement, r. 9 (t). |
3.) Placement of one (I) inch Class ®c" A.C. overlay o all !
streets within oe (I) year of Council's acceptance, F
as per Compliance Agreement, Par. 9 (c). !
4.) Installation of one Cit standard street barricade, {
Bio toSeptember 1, i78. !
5.) Completion of driveway at 11340 S.W. Tigard Street. {
6,) Submission o£ one (1) as-built sanitary sewer mylar. |
