RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN PUBLIC RIGHT-OF-WAY ON S.W. HUNZIKER STREET, EXTENDING
FROM S.W. HALL BLVD. SOUTHEASTERLY 3000 FEET.
WHEREAS, an agreement was made on the 30th day of May, 1975,
between the City of Tigard, a municipality of the State of Oregon,
and Kearney Bros. Construction Co., a co-partnership; and
WHEREAS, said agreement was prepared and executed by the aforesaid
parties for the purpose of documenting terms, conditions, and obligations,
to effect certain public improvements to be made, via a local improvement
district known more specifically as "S.W. Hunziker Street Improvement
District"; and
WHEREAS, Department of Public Works certification has been received
that all terms, conditions, and obligations of said agreement have been
fulfilled, and
WHEREAS, the required maintenance bond has been tendered to the
City, by the Contractor, and is to remain in effect for one year,
NOW, THEREFORE, in consideration of the foregoing, the City Council
of the City of Tigard, Oregon, does hereby accept said public improvements,
subject to the aforesaid maintenance period.
