CITY OF TIGARD, OREGON
RESOLUTION No. 76- $t
A RESOLUTION AUTHORIZING A WAIVER OF FEES FOR CONDITIONAL USE PERMIT
APPLICATIONS FOR BUSINESSES HAVING OUTSIDE DISPLAYS UNDER CERTAIN
CIRCUMSTANCES.
WHEREAS, the City has heretofore not enforced zoning and other code
violations on a programmed and systematic basis due to lack of adequate
staffing; and
WHEREAS, the voters have approved the hiring of a Code Enforcement
Officer who will undertake to enforce codes on a systematic, programmed
basis; and
WHEREAS, initial investigation reveals that a large number of
businesses have, as a necessary or incidental part of their operations,
outside displays of goods and products without having obtained the
necessary conditional use permit for same; and
WHEREAS, the City Council desires to lessen the adverse impact
upon such businesses that will occur as a result of systematic
enforcement of codes and also to provide an incentive to bring
operations into compliance in as short a time as possible.
NOW, THEREFORE,
BE IT RESOLVED BY THE TIGARD CITY COUNCIL THAT:
Section 1: The Conditional Use Permit fee previously established by
resolution is hereby waived for applicants meeting all
of the following criteria:
(1) The application must be for approval of .a
pre-existing display for which a conditional
use permit has not been previously sought
and denied; and
(2) The application must be submitted within 10
working days from the date of a notice of
violation; and
(3) The conditional use permit application must be
confined to consideration of an outside display
and not include other items or matters which may
also require a conditional use permit.
Section 2: This resolution shall take effect immediately and staff is
authorized to waive the conditional use fee for those applicants
which.,meet the criteria set forth in Section 1 hereof.
