A RESOLUTION OF THE TIGARD CITY COUNCIL AND PLANNING COMMISSION,
RECOGNIZING THE ACHIEVEMENTS OF THE STATE OF OREGON LAND CONSERVATION
AiiD DEVELOPMENT COMMISSION TOWARD FURTHERING AND ASSISTING THE
ACCOMP.LI:SHMENT OF COMPREHENSIVE LAND USE PLANNING BY LOCAL PLANNING
JURISDICTIONS.
'?5 WHEREAS, the Tigard City Council, Planning Commission
and City staff have experienced a constructive and cooperative work-
ing relationship with the Land Conservation and Development Commission
and its staff in the process of accomplishing effective land use
planning for the Tigard community; and
WHEREAS, the City of Tigard is appreciative of the
recognition given its citizen involvement program by including it
in the Orgeon Land Use Work Book as an example other communities might
follow in establishing their programs; and
WHEREAS, the 1973 legislative assembly found that:
"1) Uncoordinated use of lands within this state threaten
the orderly development, the environment of this state and
the health, safety, order, convenience, prosperity and
welfare of the people of this state.
{ (2) To promote coordinated administration of land uses
consistent with comprehensive plans adopted throughout
the state, it is necessary to establish a process for
the review of state agency, city, county and special dis-
trict land conservation and development plans for com-
pliance with state-wide planning goals and guidelines.
(3) Except as otherwise provided in subsection (4) of
this section, cities and counties should remain as the
agencies to consider, promote and manage the local aspects
y of land conservation and development for the best interests
of the people within their jurisdictions.
(4) The promotion of coordinated state-wide land conser-
vation and development requires the creation of a state-
wide planning agency to prescribe planning goals and
$;) objectives to be applied by state agencies, cities,
5 counties and special districts throughout the state.
(5) The impact of proposed development projects, con-
stituting activities of state-wide significance upon the
public health, safety and welfare, requires a system of
permits reviewed by a state-wide agency to carry out state- a.
wide planning goals and guidelines prescribed for applica-
tion for activities of state-wide significance throughout
e this state"; and,
WHEREAS, the 1973,1egislative assembly adopted the policy
that:
"In order to assure the highest possible level of
liveability in Oregon, it is necessary to provide for
properly prepared and coordinated comprehensive plans
for cities and counties, regional areas and the state
as a whole. These comprehensive plans:
(1) Must be adopted by the appropriate governing body
at the local and state levels;
(2) Are expressions of public policy in the form of
policy statements, generalized maps and standards and
guidelines;
(3) Shall be the basis for more specific rules, regu-
lations and ordinances which implement the policies
expressed through the comprehensive plans;
(4) Shall be prepared to assure that all public actions
are consistent and coordinated with the policies expressed
through the comprehensive plans; and
(5) Shall be regularly reviewed and, if necessary,
revised to keep them consistent with the changing needs
and desires of the public they are designed to serve":
WHEREAS, the Land Conservation and Development Commission
in April 1976 reviewed the existing land conservation and development
plans and programs of the City of Tigard for their needed update
through the Neighborhood Planning Organization process found them to
be making satisfactory.progress towards compliance with the state-
wide planning goals and guidelines, and awarded a planning assistance
grant of $39,350 to accelerate this revision program: and,
WHEREAS, a Planning Commission workshop on August 31, 1976,
was held concerning the respective roles of the city and state planning
agencies, their authority and programs:
The Tigard City Council and Planning Commission find that:
1. The findings adopted by the 1973 legislative assembly
remain valid in 1976: and
2. The costs of uncontrolled urban sprawl are placing a
burden on the financial ability of the local government
to provide the necessary public facilities and services:
3. It is imperative to orderly urban growth that each
plan and program for land conservation and development
by the federal, state and local governments be coordinated
to eliminate conflicts between agencies;
4. The repeal of the land planning enabling legislation
of ORS 197 will be detrimental to orderly development in
Tigard and its adjacent jurisdictions.
5. The ability of the citizenry of Tigard to achieve
liveability in places where they work and live ?.s assured
by defeating ballot measure #10 which would not eliminate
the requirements that 1) governmental units involve
citizens in land use planning, 2) conflicting plans to be
resolved by an impartial body, :.ounties coordinate planning
within the county, state agencies and special districts
coordinate their plans with land use plans of cities
and counties, or cities develop plars for orderly
growth and economical provision of public services and
facilities.
NOW THEREFORE,
BE IT RESOLVED by the City Council and Planning Commission
of the City of Tigard that both bodies have gone on record as favoring
the defeat of ballot measure #10 on November 2, 1976, for the reasons
contained herein.
