RESOLUTION
6-3SRESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED
WITHIN SECTION II OF BROOKWAY SUBDIVISION.
WHEREAS, the City of Tigard Subdivision Ordinance requires the installation
of streets, sidewalks, streetlights, storm sewers, sanitary sewers, underground
utilities and other public facilities for the development of subdivisioms; and
WHEREAS, the City required the payment of fees and execution of a
Compliance Agreement, which stipulated that:
"At such time as all public improvements except sidewalks and
street trees within the said SECTION II of the subdivision have
been completed in accordance with the City's requirements,
petitioner shall notify the City of the readiness for final
inspection and upon certification by the Department of Public
Works that all requirements of the City have been met, the
petitioner will submit to the City a good and sufficient
maintenance bond in form approved by the City in the sum of
$36,108.00 to provide for correction of any defective work or
maintenance becoming apparent or arising within one year after
final acceptance of the public improvements of said SECTION II'
by the City"; and further that
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance
Bond, the City Council agrees to accept the public improvements,
subject to the requirements for correction of deficiencies and
maintenance for a period of one year as hereinabove set forth";
and
WHEREAS, the petitioner has now requested final inspection; and
WHEREAS, said certification has now been received, that all required
construction is satisfactorily completed, along with a recommendation
to forego the requirement of the aforementioned maintenance bond,
since the (project) performance bond remained in effect throughout
the normally required one year maintenance period,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon,
hereby accepts the public improvements constructed within SECTION II of
BROOKWAY Subdivision, said subdivision being recorded in Book 28 on Page 1
in Washington County, Oregon, Plat Records,

{ AND FURTHER, the City Council hereby nullifies the requirement
of submission of the aforesaid maintenance bond.
