Resolution No. 76-01 CITY OF TIGARD, OREGON RESOLUTION No. 76- / RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN TERRACE TRAILS SUBDIVISION. WHEREAS, the City of Tigard Subdivision Ordinance requires the installation of streets, sidewalks, streetlights, storm sewers, sanitary sewers, underground utilities and other public facilities for the develop- ment of subdivisions; and WHEREAS, the City required the payment of fees and execution of a Compliance Agreement, which stipulated that: "At such time _s all public improvements except sidewalks and street trees within said subdivision have been completed in accordance with the City's requirements, petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the petitioner will submit to the City a good and sufficient maintenance bond, if not already provided with the performance bond, form approved by the City in the sum of $81,943.75 to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year after final acceptance of the public improvements of said subdivision by the City"; and further that "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth"; and WHEREAS, the petitioner has now requested final inspection; and WHEREAS, said certification has now been received, subject to the hereinafter listed conditions, and WHEREAS, said maintenance bond has been received NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Terrace Trails subdivision, said subdivision being recorded in Book 34 on Page 37 in Washington County, Oregon, Plat Records, subject to completion of the following: 1.) installation of all sidewalks by April 15, 1978, as per Compliance Agreement, Par. 9 (2). 2.) placement of one (1) inch Class "C" A.C. overlay on all streets within one (1) year of Council's acceptance, as per Compliance Agreement, Par. 9(c). 3.) submission of one (1) as-built sanitary sewer mylar.
