RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMEM CONSTRUCTED
WITHIN PUBLIC RIGHT-OP-WAY ON S.W. 115TH AVENUE, FROM S.W. GAARDE STREET TO A POINT

€ WHEREAS, an aZ;reement was made on the 7th day of April, 1972, between the
City of Tigard, a municipality of the State of Oregon, and Nick Bunick and
Robert L. Msndish, d/d/a Columbia Custom Homes and Giant Financial Corporation,
an Oregon corporation; and
WHEREAS, said agreement was prepared and executed by the aforsaid parties
for the purpose of documenting terms, conditions, and obligationa, to effect
certain public improvements to be made, from the intersection of S.W. Gaarde
Street/S.W. 115th Avenue extending northerly therefrom approximately 857 feet
along S.W. ]15th Avenue; and
WHEREAS, formal request to initiate City proceedings to accept said improve-
ments has been received by the Department of Public Works; and
WHEREAS, the required one year maintenance period has lapsed; and
WHEREAS, the required certification that all requirements have been met,
as stipulated, has been tendered by the Department of Public Works to the City
Council;
NOW, THEREFORE, in consideration of the foregoing, the City Council of the
City of Tigard, Oregon, does hereby accept said public improvements.
