RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED
WITHIN SUMMERFIELD SUBDIVISION SUBJECT TO HEREIN SPECIFIED CONDITIONS. j
WHEREAS, the City of Tigard Subdivision Ordinance requires dubdividers to install
streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities E
and other public facilities for the development of subdivisions; and
WHEREAS, the City has required the payment of fees, the execution of a cash
bond escrow agreement and the execution of a compliance agreement which stipulates
hlE that:
<f...: "Upon receipt of certification by the Department of Public Works, that all
requirements have been met, and a one year maintenance bond, the City
Council agrees to accept the public improvements, subject to the requirements
i' for correction of deficiencies and maintenance for a period of one year..."; and

11HEAEAS, Said certification has now been received; and
2,.. WHEREAS, the developer of said subdivision has specified, via Exhibit "A" }
;t- attached 'hereto, a desire to maintain the existing cash bond escrow agreement tt
(performance bond) in full force and effect, in lieu of submitting a separate 6
maintenance bond, throughout the required maintenance period of one year. :$
NOW, THEREFORE, 9'

BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby
accepts the public improvements constructed within Summerfield, said subdivision '
plat being recorded in Book 32 on Page 50 in Washington County, Oregon, Plat
;;,.. Records, subject to:

1.) Continuance of the aforementioned security, in full force and effect,
for a period of one year from the date of this resolution, for
correction of deficiencies and maintenance purposes.

Dear Mr. Heibert:
In reference to the Maintenance Bond amount for Summerfield
Phase I Construction, the original Letter of Committal
from Benjamin Franklin Savings and Loan setting aside the
funds for construction, also more than adequately covers
the $1,850.00 maintenance amount that was submitted by
your office.
As per your request we are submitting this letter to re-affirm
and to eliminate any liability from maintenance standpoint of
the City of Tigard for a period of one year from date of
acceptance by the Tigard City Council.
