Resolution No. 75-14 =s CITY OF TIGARD, OREGON RESOLUTI014 No. 75-)4 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN SUMMERFIELD II SUBDIVISION SUBJECT TO HEREIN SPECIFIED CONDITIONS, WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to e. Nf install streets, sidewalks, street ligfi ts, storm sewers, sanitary sewers, underground G utilities: and other public facilities for the development of subdivisions; and . WHERE.S, the City has required the payment of fees, the execution of n cash bond escrow agreement and the executi^n of a compliance agreement which stipulates that: ?.� "Upon receipt of :erti£ice tion by the Department of Public Works, that all requirements have been met, and a one year maintenance bond, the City Council c.. agrees to accept the public improvements, subject to the requirements for 1{ 4+. correction of deficiencies and maintenance for a period of one year..."; and WHEREAS, the said certification has now been received; and C WHEREAS, the developer of said subdivision has specified, via Exhibit "A" $' attached hereto, a desire to maintain the existing cash bond escrow agreement (perfozmance bond) in full force and effect, in lieu of submitting a separate �. maintenance bond, throughout the required maintenance period of one year. s, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby accepts the public improvements constructed within Summerfield II, said subdivision plat being recorded in Book 33, Page 39 in Washington County, Oregon, Plat Records, subject to: S 1.) Continuance of the aforementioned security, in full force and effect, for a period of one year from the date of this resolution, for correction of deficiencies and maintenance purposes. As per your request we are submitting this letter to re-affirm and to eliminate any liability from maintenance standpoint of the City of Tigard for a period of one year from date of acceptance by the Tigard City Council.
