Resolution No. 75-08 �2 CITY OF TIGARD, OREGON RESOLUTION No. 75- 2 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN LAKE TERRACE SUBDIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS. WHEREAS, the City of Tigard Subdivision Ordinance requires sub- dividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City required the payment of fees, the execution of a performance bond, and the execution of a Compliance Agreement which stipulated that: "Upon receipt of certification by the Department of Public Works that all requirements have been met, and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year..."; and WHEREAS, said Certification has now been received subject to correction of hereinbelow .listed deficiencies; and WHEREAS, the developer of said subdivision has specified his desire to have the City retain the previously submitted performance bond In full force and effect, in lieu of submitting a separate main- ; tenance bond, subject to the aforesaid maintenance period; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Lake Terrace subdivision, said subdivision being recorded in Book 34 on Page 20 in Washington County, Oregon, Plat Records, subject to: 1. Completion of sidewalks, as spec_fied in said Co,npliance Agreement. 2. Installation and energizing of (6) streetlights, as per the approved plans. 3. Placement of a one inch class "C", A. C., overlay on all streets, as specified in said Compliance Agreement. 4. Replacement of damaged curb sections, as specified by (file) letter dated October 11, 1974. 5. Receipt by she City of an as-built sanitary sewer and street sepia, as prepared by the developer's engineer. AND FURTHER, that the aforesaid performance bond is to remain in full force and effect, subject to the conditions of obligation of the aforesaid maintenance period.
