RESOLITPION No. 74-
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC
IMPROVEMENTS CONSTRUCTED WITHIN SALEM FREEWAY SUBDIVISION
AND THEREIN A DEDICATED PUBLIC ROADWAY KNOWN AS S.W. SANDBURG
STREET.

WHEREAS, the City of Tigard Subdivision Ordinance requires the
installation of streets, sidewalks, streetlights, storm sewers,
sanitary sewers, underground utilities and other public facilities j
for the development of subdivisions and dedicated public roadways; f
and
WHEREAS, the developer of Salem Freeway Subdivison and (of}
S.W. Sandburg Street has now requested simultaneous City accept-
ance thereof, said projects being contiguous and sequentially
constructed by the developer though independently documented; and
WHEREAS, the City has required the payment or fees and execution
Of Compliance Agreements, which stipulate that;
"Upon receipt of certification by the Department of Public
Works that all requirements have been met and a One Year
Maintenance Bond, the City Council agrees to accept the public
improvements, subject to the requirements for correction of
deficiencies and maintenance for a period of one year....` and .
WHEREAS, said Certification has now been received subject to
correction of hereinbelow listed deficiencies; and
- WHEREAS, an acceptable one year Maintenance Bond has now been
re ceive'3 for Salem Freeway Subdivision, such not being required for (
S.W. Sandburg Street (project) since its performance bond remained R
in effect throughout the normally required one year maintenance t
period,
NOW, THEREFORE,

BE IT RESOLVED that the City Council of the City of.Tigard,
Oregon, hereby accepts the public improvements constructed within
Salem Freeway Subdivision, said subdivision being recorded in E�ok
32 on Page 20 in Washington County,Oregon, Plat Records, subject to:
1. Completion of sidewalks, as per the original agreement_.
2. Replacement of one (15') curb section, prior to expiration
of the maintenance period.
3. Conditions of obligation of the aforesaid Maintenance Bond
(for $27,913.00), to expire one year from this acceptance.
AND FURTHER, the City Council hereby accepts the public improve-
ments constructed therein S.W. Sandburg Street (project), said roadway
being dedicated to the public in Book 845 on Pages 829-831 in
Washington County, Oregon, Records, subject to:
I. Installation of street trees along the North side of S.W.
Sandburg Street, as may be approved by the Planning Commision;
with a suitable performance bond to be submitted to insure
completion thereof.
