RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC f
IMPROVEMENTS CONSTRUCTED WITHIN PENROSE TERRACE SUBDIVISION, j
SUBJECT TO COMPLETION OF SIDEWALKS TH DEIN. �.

WHEREAS, the City Council previously accepted certain public {
improvements constructed within Penrose Terrace Subdivision, via I!
Resolution No. 73-47, subject to completion of four (4) items
specified therein and Further subject to a One Year Maintenance
period, and
WHEREAS, items number two (2), three (3) and Four (4),
, have since been satisfactorily
completed and the required maintenance period has expired, and
specified in said resolution
WHEREAS, a certain inequity exists within (specified) item .
_ number one (1) of said resolution being, more specifically, that
the.-deadline stipulated for completion of installation of t
sidewalks under phase II construction is the same as that which
was stipulated for phase I construction; both phases being
documented via a singular compliance agreement though being
constructed sequentially; and
WHEREAS, the developer of said subdivision has now requested �..
final City acceptance of all of the public improvements constructed
therein said subdivision and has also requested an extension of
the time of completion requirement for sidewalks for phase II
construction within said subdivision,
NOW, THEREFORE, +�+
BE IT RESOLVED that the City Council of the City of Tigard, f
Oregon, hereby accepts the public improvements constructed within !.
Penrose Terrace subdivision, said subdivision being recorded in )
Book 39, o.. Page 45 in Washington County, Oregon, Plat Records,
subject to: i
1. Completion of Phase II sidewalks as per the approved con- - .
struction plans therefor. r
TND, that the City Council of the City of Tigard, Oregon, {i
hereby grants an extension of said sidewalk completion deadline i
to August 4th, 1976.
AND FURTHER, subject to the conditions of obligation of a
performance band therefor.
