RESOLUTION No. 74-yy
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC
IMPROVEMENTS WITHIN A STREET DEVELOPMENT PROJECT KNOWN AS
S.W. MURDOCK STREET & S.W. 109th AVENUE, SUBJECT TO HEREIN
SPECIFIED CONDITIONS.
WHEREAS, the City of Tigard requires that certain provisions
of access and egress be met, prior to use of any structure or
parcel of real property, and further requires that certain
standards of construction be met, and
WHEREAS, in the development of a project known as "S.W.
Murdock Street & S.W. 109th Avenue.", those certain provisions
and standards were reaulre , and
WHEREAS, the City also recuired, the payment of fees, the
furnishing of certain securities and the execution of a Compliance
Agreement' which stipulated that:
"Upon receipt of certification by the Department of Public
Works that all requirements have been met and a One Year
Maintenance Bond, the City Council agrees to accept the
,. public improvements, subject to the requirements for
correction of deficiencies and maintenance for a period
of one year..."; and
WHEREAS, said Certification has now been received subject to
correction of hereinbelow listed deficiencies; and
WHEREAS, an acceptable Maintenance Bond has now been received
and is subject to the aforesaid maintenance period,
NOW, THEREFORE,
BE IT RESOLVED, that the City Council of the City of Tigard.
Oregoa, hereby accepts the public improvements constructed within
and for said street development project, subject to:
1.) Installation and energization of eight (6) streetlignts.
2.) Submission of an acceptable as-built sanitary sewer cepia.
AND FURTHER, subject to the conditions of obligation of the
aforesaid Maintenance Bond.
