Resolution No. 73-35CITY OF TIGARD RESOLUTION No. 73 - A RESOLUTION APPROVING AN AGREEMENT WITH THE ENGINEERING FIRM OF HARRIS-McMONAGLE ASSOCIATES FOR ENGINEERING SERVICES RELATED TO PROP 3ED IMPROVEMENTS TO COMMERCIAL AND HUNZIKER STREETS, AND AUTHORIZING THE MAYOR AND RECORDER TO EXECUTE SAME. Be it resolved by the City Council of Tigard, Oregon that. Section Li An agreement, a copy of which is on file in the office of the City Recorder, between the City of Tigard and Harris-McHonagle Associates, an engineering firm, relating to proposed improvements to Commercial end Hunziker Streets, is hereby approved in all its particulars and the Mayor and City Recorder are hereby authori>ed to execute said agreement. Mayo I ATTEST: 111:,. .-,r Recorder ,f A G R E E M E N T This Agreement made this _~41 day of 1973 by and between the CITY OF TIGARD, acting herein by and through its Mayor who is duly authorized so to act and in behalf of said city, hereinafter called the "City", and Harris-McMonagle Associates, a partnership. WHEREAS, the City desires to employ an engineer to furnish engineering services for the City's project consisting of Commercial and Hunziker Street Local Improvement Districts located in the City of Tigard, Washington County, Oregon, and WHEREAS, the Engineer has submitted a proposal for the aforesaid engineering work dated September 11, 1973, signed by James R. HnrriS the terms and conditions of which proposal including, fees are satisfactory to the City. NOW, THEREFORE, This Agreement Witnesseth: That for and in consideration of the mutual covenants and promises between the parties hereto, it is hereby agreed that the Engineer shall furnish engineering services and the City shall make payment for same in accordance with the terms and conditions set forth in said proposal and marked "Exhibit A", which said proposal is attached hereto, and is hereby made a part hereof. COMME21ROIAL 6TRnMT TIOa1RD, ORIGOOW 97223 TRLHPIIONM (608) 639-3468 September 13, 1973 Mr. Bruce Clark City Administrator PO Box 23557 Tigard, Oregon 97223 Dear Bruce: CITY OF TiGAR0 This rill confirm our conversation of September 7, 1973 concerning our proposal to provide engineering services for the following proposed street local improvement district projects: SW Hunziker between Hall Blvd. & State R/W SW Commercial between Main St. & Hall Blvd. Walnut-Mederman: a. SW Walnut between Tiederman & West line of School Property. b. SW Tiederman between Walnut and North line of School Property. These projects can be broken down into three phases; preliminary, design and construction. The services we will provide for each of these phases are as follows: 1.0 - Preliminary Phase 1.1 - Basic Services: a. Preparation of preliminary layouts and designs with cost comparisons of the alternatives and our recommendations. b. Preparation of the preliminary plans ruid profiles for presentation to the participants in the L.I.D. and city council. These plans would be prepared utilizing aeri.i mapping at a scale of 1"=500. C. Preparation of preliminary cost estimates. d. Provide assistance in determining the method of assessment. e. Calculate the assessment to each participant in the L.I.D. and prepare a map showing ownership and boundary of assessment area. f . Attendance at meetings and conferences to assist you and your staff in describing the proposed project and answering questions that will certainly come up. Mr. Bruce Clark Page 2 1.2 - Special Services: a. Engineering surveys and field control for photogrammetrIc work. b. Aerial photography and mapping. c. Land surveys, as may be required, d. Soils investigations, as may be required. 2.0 - Design Phase 2.1 - Basic Services: a. Preparation of detailed contract drawings. These plans would be prepared utilizing the aerial mapping and data from the preliminary phase and would include all detail drawings required for construction. Scale would be 1"=50' horizontal and 111=101 vertical. b. Coordinate design with affected utility companies. c. Preparation of specifications and contract documents. d. Preparation of final cost estimate and assessments based on this estimate. e. Attendance at meetings as required. 2.2 - Special Sorvicea: a. Final location survey work that may be required. b. Land surveys and legal descriptions that may be required. 3.0 - Construction Phase 3.1 - Basic Services: a. Assistance in advertising for bids, securing bids and selection of the contracltpr::, and award of the contract. b. Consultation during construction as needed and visits to the projects during construction. c. Preparation of supplementary drawings that may be required to resolve field conditions encountered during the course of construction. d. Preparation of "As Built" drawings upon completion of the project. ia~ t,- C Mr. Bruce Clark Page 3 3.2 - Special Services: a. Construction staking b. Final surveys as may be required for preparation of "As Builts". Our fees for the Basic Services would be based on a percentage of the net construction cost as set forth on a Curve A in the American Society of Civil Engineers Manual 45, a copy of which T_ have enclosed for your use. Our Basic Service fee would be 12% of the net construction cost for eny of the projects where the cost was less than $100,000.00. In the event any of the projects were abandoned our fee for Basic Services would be computed based on the estimated construction cost and allocated as follows: Preliminary phase . . . . . . . . . . . 50% of total Design phase . . . . . . . . . . . 35% of total Construction phase . . . . . . . . . . . i5% of total Our fees for Special Services are as follows: Principal surveyor . . . . . . . . . . $1$.00/hr. Technician/draftsman . . . . . . . . . 12.50/hr. 3-man survey crew . . . . . . . . . . 34.00/hr. 2-man survey crew . . . 26.00/hr. Outside Services - Invoice cost plus 10016 The above survey crew costs include equipment, mterials and vehicles.
