Resolution No. 73-28 CITY OF TIGARD RESOLUTION No. 73 A RESOLUTION ESTABLISHING AND ADOPTING A POLICY GOVERNING THE ISSUANCE OF SEWER PERMITS FOR THE CITY OF TIGARD. WHEREAS, under the provisions of a D.E.Q. approved system of sewer permit restrictions, the City of Tigard is constrained to the issuance of 200 connections to the Tigard Sanitary Sewer System over the next 12 month period; and WHEREAS, it is the City Council's intention to adopt a sewer permit allocation system which will provide the greatest benefits to the citiaeas of Tigard while being as equitable and balanced a system as possible under the constraints placed upon the City. NOW, THEREFORE, BE IT RESOLVED, by the City Council of Tigard thatt Section 1: That the memorandum to City Council dated August 17, 1973 entitled "Sewer Permit Allocations - Recommendation" a copy of which is attached hereto and made a part hereof be adopted in.-its entirety and that said memorandum shall stand as the policy of the City of Tigard in the matter of allocation of sewer connections. Section 2s This resoaution shall become effective immediately upon passage and approval and the City Administrator is directed to cause the issuance of connections in accordance with the provisions of this resolution. Clark Subjects Sewer Permit Allocations - Recommendation Under the provisions of the D.E.Q. approved system of sewer permit restrictions, the City of Tigard is allowed to issue 200 permits to the Tigard Plant between August, 1973 and August, 1974. The staff has been able to identify requests and potential need for over 550 connections. Thus it is obvious that whatever allocation systems is adopted, it will not satisfy the demand. We have used our knowledge and records to develop the allocation policy proposed herein. It is believed that this system will provide the greatest benefit to the City and its citizens while still being as balanced and equitable as possible considering the severe constraints imposed upon the City. Three general categories are proposed as follows: (1) Public, Health & Emergency; (2) Residential; and (3) Commercial/Industrial. The largest number of permits have been allocated to the Commercial/Industrial category for the following reasons: 1. Commercial/Industrial construction with its higher valuations, will tend to expand the tax base; thereby providing a benefit to the existing residential taxpayers over the next two year period. 2. Upon completion, Commercial/Industrial construction will provide jobs & pay- .rolls- thereby contributing further to the desirability of living in Tigard. The eventual effect will be to sustain the housing market so that indirectly: an emphasis on Commercial/Industrial during our "period of constraint" will tend to be to the eventual benefit of the subdivider, the home builder and the home owner. 3. It has been w *11 documented over the past 10-15 years that single family development does not "pay for itself" in terms of tax revenues received related to services provided. 4. Regionally, the County has determined to place its emphasis on residential construction. 5. Certain Tigard area subdivisions will be able to continue to provide new residential unite due to the fact that they do not connect to the Tigard Plant. It is the staff's proposal that the following delineated allocation policy be reviewed within 5 months to allow for adjustments in the policy if development is not occuring as anticipated. With the exception of building permit applications, which were submitted and in process prior to the moratorium, the staff recommends that no reservations for specific projects or buildings be made in advance as to do so would tend to be arbitrary and inequitable. In City applicants should have priority over out of City contract users. Page 2 August 17- 1973 The staff recommends that all 200 permits be utilized during the present fiscal year so as to limit adverse impact upon the City's budget. Finally, the staff recommends that residential sewer permits be limited to single family detached development with certain restrictions. PROPOSED ALLOCATIONS Category N_. Percent 1. Public, Health & Emergency 10 5% 2. Residential 60 30% 3. Commercial/Industrial 130 65% TOTAL 200 100% Priorities Within Allocations Public. Health & Emergency The allocation to this category has been cut to the minimum in order to allow for full utilization of the available permits by the community at large. It is proposed that if any connections remain to be allocated in this category by April, 1974, that they be transferred to one of the other categories. The allocation of these permits to be solely at Council's discretion. Residential 1. All residential building permit applications submitted and in process prior to the moratorium will be honored. There are a total of 16 such connections. 2. No permits will be issued for construction in new subdivisions which were not of record as of the date of the moratorium. However, subdivisions presently being reviewed by the City, will continue to be processed so that at the time capacity becomes available, developers will be able to proceed with construction. 3. Subdivisions containing lots of record at the time of the moratorium will be able to obtain sewer permits on a first come, first serve basis subject to the condition that the pi.,posed construction be under contract to a prospective buyer. No sewer permits will be issued for speculative construction. The City shall require proof that the proposed construction has a legitimate purchaser iu advance. 4. Sewer permits for residential construction other than a portion of the connections specifically allocated under 1 above, shall be limited to single family detached units. CcmmmercillIndustrial 1. As in the case of residentixual construction, all commercial/industrial building permit applications submitted and in process prior to the moratorium will be honored. The rest of the available co®ercial/industrial connections will be issued on a first-come first-serve basis. Only complete building permit applications will be accepted and insufficient or incomplete sets of plans will be returned to the applicant. Allocation of sewer permits will be made only after approval of building permit applications. All applicable requirements set forth in the Zoning and Subdivision chapters of the Tigard Municipal Code shall be met before a set of construction plans and specifications will be accepted for review by the City. Alternative Methods of Sanitary Sewage Disposal Due to the severity of the constraints placed upon sewer connections, the staff recommends that the City allow alternative methods of sanitary sewage disposal on a temporary basis subject to a legally binding commitment to (1) coaeenct to the public disposal system at such time as capacity in said system is available and (2) to pay whatever fees and charges are in effect at the time of connection. Such temporary facilities to be allowed at the applicants election and subject to all x currently acceptable engineering and health standards of construction and design and further subject to approval by all appropriate governmental agencies. a TAY' R 3 r! c1 BFC:lr
