WHEREAS, in connection with the Derry Dell Trunk Sewer Improve-
ment District, Lot 5, Block 4, FAIRHAVEN COURT, Washington County,
Oregon, was assessed in the sum of $798.53, and the record title
holders thereof, to-wit, NOEL M. FERRY and JUDITH E. FERRY, applied
under date of January 12, 1971, for bond of said assessment and to pay
the same pursuant to §§223.205, et seq., ORS; and
WHEREAS, said applicants have failed and neglected and refused
to pay the said assessment, or any part thereof, and the same is now
delinquent with respect to installments falling due on the 15th days
of September, 1971, March and September, 1972; and
WHEREAS, It is necessary pursuant to§223.205, et seq., and
§223.270 ORS, to enforce the lien of said assessment in order to
provide funds wherewith to pay the bonded indebtedness with respect
to the Derry Dell Trunk Sewer Improvement District;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Tigard, as follows:
(a) That the City's attorneys be, and they are hereby, authorized
and directed to take such proceedings as necessary to foreclose the
lien of said assessment in the sum of $795.53, together with interest
thereon at the rate of 7% per annum, with respect to Lot 5, Block 4,
Fairhaven Court, Washington County, Oregon, the record owners thereof
being NOEL M. FERRY and JUDITH E. FERRY, and said attorneys are further
authorized to incur such reasonable and necessary expenses in connec-
tion with said legal proceedings as usual and customary in the premises.
(b) The City Recorder be, and she is hereby, authorized to verify
all necessary pleadings incident to said foreclosure proceedings on
behalf of the City.
