Resolution No. 69-20 RESOLUTION ENDORSING THE PROPOSED FORMATION OF
A COUNTY SERVICE DISTRICT PURSUANT TO THE PRO-
VISIONS OF CHAPTER 451, OREGON REVISED STATUTES,
AS AMENDED BL CHAPTER 646, OREGON LAWS OF 1969.
WHEREAS, pursuant to the provisions of Chapter 451, Oregon
Revised Statutes, as amended, Washington County through its Board
of Commissioners has causedto have prepared a Sewerage and Water
Facilities Master Plan for the Tualatin Basin; and
WHEREAS, the Washington County Board of Commissioners has
initiated proceedings to establish a County Service District as the
media whereby, through unified approach, the sewage disposal prob-
lems of the various districts and the cities within the County can
best be solved; and
WHEREAS, pursuant to order issued on September 26, 1969, by
the State Department of Environmental Quality, the City of Tigard,
along with other similar bodies and districts within Washington
County, ha.: been directed to forego Issuance of sewer connection per-
mits on a generalized basis until such time as a unified program to
overcome the problems of sewage disposal in the Tualatin B-sin has
been effectuated; and
WHEREAS, the City Council of Tigard considers that the best
interests of the people of the City of Tigard and the surrounding area
require that the City of Tigard Join with the other bodies in a
common effort to accomplish the formation of a County Service District
and to provide the necessary sewerage collection and disposal facili-
ties,
WHEREAS, the City Council has heretofore been advised by the
City Attorney that, in the opinion of counsel, doubt exists under the
statutory authorities as to whether or not the City Council may properly
authorize the inclusion of th.. City in formation of a county service
district in the absence of consent of the{bters of the City, and
WHEREAS, the COuncilca< the City of Tigard desires to consent
to the inclusion of the City in the formation of the County Service
District to the extent thatthe Council Is authorized by resolution to
permit the area of the City to become part of the County Service Dis-
trict,

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TIGARD
as follows:
1. That the City Council of the City of Tigard does hereby
express its continued support of the proposal of the Washington County
Board of County Commissioners to form a county service district as here-
tofore initiated by Washington County pursuant to Chapter 451, Oregon
Revised Statutes and Chapter 646, Oregon Laws of 1969.
2. That to the extent the City Council of Tigard Is authorized
by the statutes of the State of Oregon and/or the Charter of the City
of Tigard so to do, the City Council of the City of Tigard does hereby
consent to the inclusion of the area within the City of Tigard within
the boundaries of the proposed County Service District with the intent

and purpose that the area of the City of Tigard will become part
thereof.
3• That this resolution shall be binding upon the City of
„! Tigard only to the extent that the City Council may lawfully assent
to the inclusion of the City in a county service district to be formed
for the purpose of constructing, maintaining, and operating sewerage
collection treatment and disposal facilities.
4. That the City Recorder be, and she is hereby, authorized
and directed to forthwith cause to have certified and delivered to the
Hoard of County Commissioners, Washington County, Oregon, a copy of
this resolution for inclusion in the records of proceedings for the
formation of a county service dLstrict.
