Minutes of meeting March 14, 1962 read and approved. Three members of Tigard Junior C' 4 2}aipber of Commerce were present i and spokesman, Jim Parker, presented their request that the Council i proclaim the week of April lst thru 7th "Chicken Fat Week" in Tiggrd in an effort to promote President Kennedy's physical fitness program. During that week the Junior Chamber will sponsor the sale of the re- cording "Chicken Fat" at 500 each. Councilman Woodard MOVED that the council help promote the program by proclaiming the week of April 1st thru 7th "Chicken Fat week" in Tigard, SECOND by Council- man Verharen, and approved. 'Y Mr Willis West, 165555 W 65th Avenue, was present and announced 1, he had just been advised that finally the two railroad companies �r. and the State Highway Commission had gotten together and agreed to 'k install the much needed Signal Light over the railroad crossing on r Highway 217. It was Mr West's understanding that the cost is to be shared by the two interested railroad companies and the State High- way Department. : Attorney Anderson went over the final draft of the West Coast Tele- phone Company Franchise and recommended it be accepted. Councilman Verharen MOVED that the Council enact the Ordinance granting the Went Coast Telephone Company Franchise, SECOND by Councilman Hanneman and unanimously so VOTED, it thus becoming City of Tigard Ordinance No. 62-9. Mr Klock had Objectfd to the Rawer. line running straight because of the need to protect trees on his property, Engineer Carter had sug- gested that the sewer line come in off center on an angle and the water line come in from 90th, which he approved if it met with ; { Council approval. After discussion it was MOVED by Councilman Ver- haren that the Council accept the angle sewer connection and the i, water line from the East end of 90th, to the Blevins and Klock pro- perty SECOND by Councilman Woodard and unanimously approved. r'. 4 C THIS AGREEMENT, Made this jq day of March, 1962, be- tween the CITY OF TIGARD, acting by and through its duly author- ized, undersigned officers, hereinafter termed the City, and MOTE'S PHARMACY, INC., hereinafter termed Mote's, .41T"T-,SSETH: That for and in consideration of the mutual benefits to be derived hereunder, the City does hereby make, constitute and des- ignate Mote's as agent of the City to receive payments as and when same fall due from sewer services rendered patrons of the City's sewer system, and to issue to such patrons in exchange for said payments, good and sufficient receipts therefor. IT IS FURTHER AGREED, that at regular intervals, Mote's shall promptly pay over to the City Clerk or City Treasurer, all funds received by Mote's under the terms hereof. The City shall pay to Mote's by the 10th of the month fol- lowing, for the services to be rendered hereunder, a sum equal to two per cent (27) of the amount received by and accounted for by Mote's during the prior calendar monrh; to be charged against the sewer service account of the City. In consideration hereof, Mote's agrees to act as collection agent and to receive payments only for sewer services, and not in- cluding any other funds of the a.1ty, and to provide the City with an accounting each month of all funds received, showing the name of each payor and the amount of the payment, and Mote's further agrees to keep and maintain all collections separate and apart as trust funds belonging to the City. It was agreed there were several controversial delinquent accounts where there Is actually no sewer connection that should have some study prior to this. Councilman Woodard suggested the Council have a pamphlet printed up covering City Ordinances 62-1 and 62-2, regulations and costs of sewer charges. Councilman Woodard would check into cost and report at next regular meeting. There was discussion of the Budget, first publication of which had been made May 17, 1962, the second would appear May 24, 1962, the public hearing to be held June 7, 1962. On MOTION BY Councilman Woodard, SECONDED by Councilman Verharen, and unanimously passed, the following Resolution was adopted: RESOLVEDs 'V That a special election be held in the city of Tigard between the hours of 8:00 a.m. and 8:00 p.m. on the 15th day of June, 1962, to submit to the legal voters of the City of Tigard, Oregon, the following propositions: For the reason that the City of Tigard has no tax base within the limitation of Section 11, Article X1 of the Constitution of the State of Oregon, and insufficient fudds are available to cover the necessary personal services, maintenance and operation costs, a special levy to raise $12,600.50 is hereby referred to the voters: Shall the City of Tigard, Oregon, be authorized to levy for personal services, operation and maintenance of the City for the year-beginning July 1, 1962, and 7 ending June 30, 1963, the sum of $12,600.60. i For the reason that it is necessary to obtain suitable quarters for use as city hall to conduct the municipal affairs of the City of Tigard, Oregon, it in proposed to purchase the site and improvements constituting the former Tigard Branch, United States National Bank at 12420 S W Main Street in the City of Tigard, Oregon, for the cash purchase price of $16,000.00, and to provide an additional sum wherewith to improve said premises for city hall purposes, a special levy to raise $18,700.00 is hereby referred to the voters: Shall the City of Tigard, Oregon, be authorized to levy for the year beginning July 1, 1962, and ending June 30, 196$, for the yYrpbeae'of real property and improvements and necessary renovations for city hall purposes the sum Of $18,700.00. 1 - Resolution 5-21-62 Page 4. RESOLVED: That notice of said election be given by posting in four public and conspicuous places within the City of Tigard, Oregon, for not less than twenty days prior to date of said election, and by publish- ing notice thereof in the Tigard Times on May 24 and 31, 1962, and June 7 and 14, 1962. RESOLVED: That the City Clerk and City Attorney be authorized and directed to cause to have the said notices given. election materials prepared, and to take any and all other steps required incident to the holding and conducting of said election. RESOLVED: that Mrs James Aitken, Mrs Tom Fisher, Mrs Francis Cooper, and + Mrs Roscoe Winters, electors of the City of Tigard, be, and they are hereby, designated to act as a board of election, and the City Clerk be, and she is hereby, directed to give notice to the respective members of the election board of each of their appointments.
