Ordinance No. 99-17 CITY OF TIGARD,OREGON
ORDINANCE NO.99-1-7
AN ORDINANCE APPROVING COMPREHENSIVE PLAN AMENDMENT (CPA 99-00001),
SENSITIVE LANDS REVIEW (SLR 99-00003),AND TITLE 3 CONDITIONAL USE REVIEW,
REQUESTED TO CONSTRUCT FANNO CREEK TRAIL IMPROVEMENTS AND
DECLARING AN EMERGENCY.
WHEREAS, the applicant has requested approval of a Comprehensive Plan Amendment to the City's
Water Resources Overlay, Sensitive Lands Review, and Title 3 Conditional Use Review to construct
sections of the Fanno Creek Bicycle/Pedestrian Trail;and
WHEREAS,on June 7, 1999,the Planning Commission held a public hearing and recommended approval
of the aforementioned land use applications,subject to the ficdings and Conditions of Approval included in
the attached Exhibit"A";and
WHEREAS, on June 22, 1999, the City Council held a public hearing and approved the aforementioned
land use applications, subject to the findings and Conditions of Approval included in the attached
Exhibit"A."
NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: The proposal is consistent with all of the 'relevant criteria as noted in the attached
Planning Commission recommendation to the Tigard City Council, also referred to as
"Exhibit A."
SECTION 2; The City Council approves the Comprehensive Plan Amendment, Sensitive Lands
Review, and Title 3 Conditional Use Review, subject to the Findings and Conditions
of Approval as set forth in the attached"Exhibit A."
SECTION 3: Because the prompt implementation of this ordinance is necessary to complete the
construction of the Fanno Creek trail improvements during the current building season,
an emergency is declared to exist,and this ordinance is effective upon its passage by the
Council.
