Ordinance No. 97-03 9 ' F CITY OF TIGARD,OREGON - �` ;arc } i t w SCA ORDINANCE N0.97-03 AN ORDINANCE CONCERNING THE VACATION OF A TWENTY (20) FOOT SLOPE > a ¢ EASEMENT ANDA DETOUR EASEMENT PER DOCUMENT NO. 89-20392 WHICH FALLS 2 WITHIN PARCEL 1 OF PARTITION PLAT NO. 1996-059 IN THE CITY OF TIGARD, r * WASHINGTON COUNTY,OREGON. ; �kx h WHEREAS,the Tigard City Council initiated this vacation request pursuant to Section 15.08.040 of the tF fir"§ Safi t. +i Tigard Municipal Code on March 25,1997; and WHEREAS,the t<ven (20)foot slopa easement and detour easement had been dedicated to the public per } ire x Docurnent No.89-20392 for the construction of SW 135th Avenue; and ` WHEREAS, the construction of Southwest 135th Avenue has been completed; and . , WHEREAS,the twenty(20)foot slope easement and detour easement is no longer necessary; and ` WHEREAS,the applicant requests to vacate that portion of the twenty(20)foot slope easement and detour easement which falls within Parcel 1 of Partition Plat No.1996-059;and t�� 1 { K � i WHEREAS,the vacation has been initiated by the City Council and approval has been recommended by the tk� Community Development Department; andf R v' WHEREAS,all affected service providers, including utility companies and emergency service providers, ,. a - have reviewed the vacation proposal and have no objections; and . rux i ' WHEREAS, a subdivision approval(SUB 95-0005)was granted on the parcel containing the easements; s and . WHEREAS, the plans submitted with the subdivision application did not reflect these easements; and 1 1 axr��'s j WHEREAS,the easements are contained within six(6)of the subdivision lots; and a� { -Ai:k fl , WHEREAS, five(5)of the lots have houses that project five(5)feet into the slope easement and two(2)of s the lots have houses that project into the detour easement; and rF ' WHEREAS, the easements do not practically affect the lots since the construction of SW 135th Avenue has "� been constructed; and f ; xy'F WHEREAS, the applicant would like to remove the appearance of a conflict between the easements and them s s v f housing units; and 4 V s '..
