AN ORDINANCE AMENDING TIGARD riNNICIPAL CODE CHAPTER 13.04 REGARDING

WHEREAS,subsection 13.04.070(b)(2)of the Tigard Municipal code provides that an application
for paying an LID assessment in installments shall be rejected by the City if the assessment
}
together with the unpaid balance of an
J g pai y previous assessments against the same property equals or
exceeds double the assessed valuation of the property;and
WHEREAS,the assessed value requirement in subsection i3.G4.W,3C6,„2J.—,..7 pnr=!2-,m-nom
owner from being able to pay an LID assessment in installments because the assessed value of the4
property is insufficient;and
WHEREAS,the assessed value of certain properties is well below the real market value of the
property,particularly in the case of partially exempt or specially assessed property;and
WHEREAS,the City Council finds it beneficial to amend subsection 13.04.070(b)(2)to allow anr �
increased number of property owners the opportunity to pay LID assessments in installments; s n
now,therefore: FF `
THE CITY OF TIGARD ORDAINS AS FOLLOWS: r

� SECTION 1: Subsection 13.04.070(b)(2)is hereby amended to read as follows:

"(2) The finance director shall accept the written application to pay in installments ;s

unless the amount remaining unpaid on the current assessment together with the
unpaid balance of any previous assessments for improvements against the same m x.
` property exceeds the real market value of the property." s
SECTION 2: Subsection 13.04.080(c)(3)is hereby amended to read as follows:
"(3) No segregation shall be made unless each part of the original tract of land 5
after the segregation has a real market value,of one hundred twenty percent or x
more of the amount of the lien as to each segregated tract concerned." f � `
