Ordinance No. 94-05 a R CITY OF TIGARD, OREGON ORDINANCE NO. 94- O AN ORDINANCE TO AMEND PROVISIONS OF THE COMMUNITY DEVELOPMENT CODE TO BE CONSISTENT WITH STATE BUILDING CODE REQUIREMENTS FOR LOWEST FLOOR ELEVATIONS FOR ONE AND TWO FAMILY STRUCTURES LOCATED WITHIN OR ADJACENT TO THE FLOODPLAIN, CODE SECTION 18.84.026(I) . WHEREAS, the City of Tigard finds it necessary to revise the Community Development Code to bring it into conformance with other agency requirements; and WHEREAS, the City of Tigard Planning Commission reviewed the staff recommendation at a public hearing on January 10, 1994 and voted to recommgnd,approval„^of the amendment to the City Council; and WHEREAS, the City Council held a public hearing on March 8, 1994 to consider the amendment. THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION ONE: The Community Development Code shall be amended as shown in Exhibit "A Language to be added is underlined; language to be deleted is shown in [brackets] . SECTION TWO: This ordinance shall be effective 30 days after its passage by the Council, approval by the Mayor, and posting by the City Recorder. Residential Construction 1. New construction and substantial improvement of any residential structurei other than a manufactured home, shall have the lowest floor, including the basement, elevated [to or above at least one foot above base flood elevation. 2. Fully enclosed areas below the lowest floor that are subject to flooding are prohibited, or shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allcrving for the entry and exit of floodwaters. Designs for meeting this requirement must _either be certified by a registered professional engineer or architect, or must meet or exceed the following minimum criteria: a. A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided; b. The bottom of all openings shall be no higher than one foot above grade; and C. openings may be equipped with screens, louvers, or other coverings or devices, provided that they permit the automatic entry and exit of floodwaters.
