Ordinance No. 93-11 CITY OF TIGARD
ORDINANCE NO. D—
AN ORDINANCE OF THE CITY OF TIGARD DECLARING THAT THE PART OF THE
TIGARD WATER DISTRICT WHICH WAS WITHIN THE INCORPORATED LIMITS OF
THE CITY IS WITHDRAWN FROM THE DISTRICT.
WHEREAS, the City of Tigard, the City of Ring City, the City of
Durham and the Tigard Water District have reached agreement on
issues concerning formation of a joint water agency; and
WHEREAS, formation of a joint water agency as agreed, requires that
the cities withdraw from the Tigard Water District; and
WHEREAS, on February 23, 1993, the City Council adopted Resolution
No. 93-08 fixing the date and time for a public hearing on
withdrawal from Tigard Water District; and
WHEREAS, notice of the public hearing was published once each week
for two successive weeks prior to the date of the hearing and
notice was also posted in four public places for the same period;
and
WHEREAS, pursuant to ORS 222.524, the City held a public hearing on
the issue of withdrawal on March 23, 1993; and
WHEREAS, the City Council has carefully considered the testimony at
the public hearing and decided that withdrawal from the Tigard
Water District is in the best interest of the City of Tigard; and
WHEREAS, pursuant to ORS 222.524, the City must declare its
withdrawal from the District by ordinance; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That portion of the Tigard Water District which was
within the incorporated limits of the City of
Tigard is hereby withdrawn from the District.
Section 2: A map illustrating that portion of the Tigard Water
District which was within the City's boundaries is
attached hereto as Exhibit "A" and incorporated
herein.
Section 3: A legal description of the area to be withdrawn
from the Tigard Water District is attached hereto
as Exhibit "B" and incorporated herein.

Section 4: Pursuant to ORS 222.465, the effective date of the
withdrawal from the Tigard Water District shall be
July 1, 1993.
