Ordinance No. 88-26 CITY OF TI:GARD, OREGON ORDINANCE NO. 88 e�Ct� AN ORDINANCE MAKING IT UNLAWFUL TO TAMPER WITH ANIMALS USED FOR LAW ENFORCEMENT PURPOSES AND DECLARING AN EMERGENCY. WHEREAS, the "figard Police Department use dogs For, police services; WHEREAS, the police have experienced situations in which people tease the dogs while locked in a patrol car; WHEREAS, dogs used for police work by other- police departments have been injured by deliberate acts; WHEREAS, the police have experienced situations where the dogs, while acting in the line of duty, have been called while chasing a suspect and while tracking evidence; and WHEREAS, the police depend on the dogs for law enforcement purposes; THE CITY OF TIGARD ORDAINS AS FOLI_.OWS: SECTION 1. The following shall. be, added to the Tigard Municipal Code, chapter 7:28. A person coazunits the crime, of tampering with a dog used for law enforcement purposes if: (1) The person intentionally tampers or interferes with a dog while the dog is acting in the line of duty by calling t:he dng, or by other, behavior attempts to distract the dog form doing or attempting to do what it has been instructed to do by a police officer; (2) The person intentionally teases, harasses, or incites a dog while the dog is caged, be i.rig transported, exhibited or exercised, or while it is within a police vehicle; or (3) The person intentionally tortures, strikes, injures, or kills a dog, b. Tampering with a dog used for- law enforcement purposes is a Class A Misdemeanor. Section 2. This ordinance is necessary to protect the general welfare and safety of the people of the City of Tigard because the safety and welfare of the police service dogs is recleiired for an efficient operation of the Police Department, therefore, an f ORDimAitlf E NO. 88,- (.D� Page 1 emergency is hereby declared to exist, and this cr•dinance shall become efifoctive immediately upon passage and approval by the City Council. " This ordinance shall be effective 30 days after its passage by the Council, approval by the Mayor, and posting by the City Recorder.
