Ordinance No. 87-72 CITY OF TIGARD, OREGON ORDINANCE NO. 87-- j AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING CHAPTER 5.20 OF THE TIGARD MUNICIPAL CODE RELATING TO APPLICATION PROCESS FOR LIQUOR LICENSES AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Tigard City Council finds that the policy intent for Chapter 5.20 of the Tigard Municipal Code was clear at the September, 15, 1986 Council Meeting; and WHEREAS, the Tigard City Council wishes to further define their intent in regarts to the process of liquor license reviews in the City of Tigard. THE. CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Chapter 5.20 of the Tigard Municipal Code, relating to Liquor License Applications Process, is hereby amended by setting a new procedure for processing liquor license applications and setting forth an appeal process for decisions by adopting the amended as set forth in the at vached Exhibit "A" and by reference made a part hereof. Underlined language (__)is to be added and bracketed language ( [ ] ) is to be deleted. Section 2: This ordinance shall become effective on or after the 31st day after its passage by the Council, approval by the Mayor and posting by the City Recorder. Review of all new liquor k license applications and annual renewal applications shall be made by the Tigard [City Council] Chief of Police. Applications for all re+!iews shall be made thirty days prior to initial use or expiration date of licenses. f "5.20.020 Temporary liquor license •- time limitation. Application for all temporary liquor .licenses shall be made to the [City Administrator] chief of Police. All temporary liquor 3` licenses shall be in effect for not more than one twenty-four- 4< hour period. "5.20.030 Applicatior. fees. All liquor license applications [f-or such annual reviews, initial reviews, or temporary reviews shall be charged twenty-five dollars for each application] shall be filed with the City Recorder and accompanied_by the appropriate fee. Filinq fees are set by resolution of the Tigard City Council. "5__20.040 Appeal process. In the event the Chief of Police issues a recommendation of denial to the Oregon Liquor Control ' Commission (OLCC_), �he shall __first notify the applicant in writinq of his intent to issue a recommendation of denial within 3 working days of receipt of the application. Twe notification shall include the reason(s) for the intent to recommend denial and_a dateand time within the next 5 working days to hear the applicant's appealer if any. The app'icant " shall have the ri.c ht: to be heard and to present witnesses and evidence purporting to refute the reasons i.ven_ by the Chief- of Police for a recommendation of denial. The hearing shall be administrative in nature and_held _before the Chief of Polices Rules of 'evidence shall not amply Upon completion of the hearing the Chief of Police shall make a finding and shall mail the finalq recommendation to the OLCC and the applicant within 2 working days of the hearing date. 1./901311
