ORDINANCE NO. 86
AN ORDINANCE AMEND NG2 ORDINANCE. 85-•-40 RELATING TO LOCAL IMPROVEMENTS AND
DECLARING AN EMERGENCY,
WHEREAS, State law in ORS 223.389 mandates the Council prescribe by ordinance
or resolution the procedure to be followed in making entry upon any land
within a proposed local improvement district; and

WHEREAS, the Council has determined it necessary to revise Ordinance 85-40.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Ordinance No. 85-40 shall be amended by addition Section 5B2 as
follows:
"As an alternative to procedures outlined in subsection (1) (a), the
Community Development Director may authorize entry upon any property;,
within the proposed districtpursuant to and for the purpose
outlined in ORS 223.010. Within a reasonable time after the enter
upon the land, the Community Development Director shall report to
the Council on the results of the entry."
SECTION 2: This ordinance is necessary for the immediate preservation of the
public health, safety, and welfare of the citizens of Tigard to allow Local
Improvement Districts to proceed without delay from entry upon property for
purposes outlined in this ordinance, and an emergency is herebydeclared to
exist and this ordinance shall be in full force and effect upon its passage by
the Council and posting by the Recorder.
